(B&A) has had an exemplary record with excellent history and quality •• delivery of its services.Since its founding in 1939,the Firm has had few,if any,disputes with clients.However, • in the course of business, it is not uncommon for A/E firms to be involved in certain disputes, most of them • from third parties incidental to the course of business. • Currently, and specifically over the past 5 years, B&A has no major pending litigation, major disputes, • contract defaults or claims other than those listed below. Furthermore, B&A has not been terminated or • • has ever foiled to complete any construction job in the past five years. • In the condominium arena it is almost certain that architects working on condominium will end up as a • party to litigation between the developer and the condominium association. Currently B&A is a party • to two such actions. B&A has resolved any issues associated with their services, but these actions stay • open until the developer settles the matter. In addition B&A is party to a suit where the client has sued • the contractor and all design consultants to resolve construction defects.
