COASTAL SYSTEMS INTERNATIONAL, INC. <br /> Litigation Summary <br /> M.K.Contractors vs. Main Highway Development, LLC <br /> Coastal Systems International-M.K.Contractors vs. Main Highway <br /> Development, LLC <br /> Coastal Systems International was named as a co-defendant in the <br /> litigation, M.K. Contractors vs. Main Highway Development, LLC., <br /> Zyscovich, Inc., Louis J. Aguirre & Associates, P.A., DDA Engineers, <br /> P.A., Kaderabek & Barreiro Consultants, Inc., and Coastal Systems <br /> International. The case number is 10-01409 CA25 as filed in the Circuit <br /> Court of Eleventh Judicial Circuit in Miami-Dade County. <br /> The General Contractor, M.K. Contractors, for the Project filed a claim <br /> against the developer and the architectural/engineering consultants on the <br /> project on January 12, 2010. The construction for the project was <br /> completed in 2007. Coastal Systems filed a motion to dismiss the claim <br /> on January 29, 2010 for failure to state a cause of action on the <br /> professional negligence and violation of Florida statute counts. M.K. <br /> Contractors is an incidental third-party beneficiary to the work <br /> performed by Coastal Systems.The design work completed by Coastal <br /> Systems was limited to the site/civil engineering and underground <br /> utilities, and therefore Coastal Systems was not involved in any structure <br /> of the Condominium, therefore making the Building Code claims <br /> inapplicable. <br /> As of June 21, 2010 the Plaintiff filed a Notice for Hearing and then <br /> cancelled Motions to Dismiss filed by Coastal Systems, Zyscovich and <br /> Louis Aguirre and Associates. The Plaintiff also filed a Motion for <br /> Clerk's Default against Main Highway Development.The Clerk of Court <br /> previously entered a Default on May 20, 2010 against Main Highway for <br /> failing to file any paper. Since filing the suit, a hearing for the Motion to <br /> Dismiss is being re-scheduled. <br /> Coastal Systems is also involved in litigation relative to liens as filed on <br /> properties relative to fee collections.
