tSJ,1NY/j/FJ O " FIRST AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF SUNNY ISLES BEACH AND LYNX CONSTRUCTION MANAGEMENT, LLC CONTRACT NO. C1516-045 This First Amendment to the Agreement between the CITY OF SUNNY 1 Y ISLES BEACH ("City") and LYNX CONSTRUCTION MANAGEMENT, LLC ("Contractor") executed this 2 day of 6,4 04, 2016, is made a part of the original Agreement, Contract No. C1415-018, between the parties dated December 30,2014,("the Agreement"),between the City and Contractor attached hereto as Attachment `B" whose Federal Identification # is1'c3 I 0 033 The City and Contractor hereby agree as follows: 1. ADDITIONAL SERVICES. Article 1 of the original Agreement is hereby amended to include window repairs at Government Center City Hall,installation of a ventilation system within two stairwells at Heritage Park, and door repairs at the Government Center Parking Garage, ("Additional Services"), as set forth in Contractor's proposal, a copy of which is attached hereto and incorporated herein as Attachment"A". 2. ADDITIONAL COMPENSATION. The payment to Contractor, as set forth in Section 5.1 of the original Agreement, is hereby amended to include additional compensation for the Additional Services, in an amount not to exceed One Hundred Twenty Thousand Seven Hundred Seventy-Nine Dollars and Thirty-Four Cents($120,779.34),bringing the total contract amount not to exceed Two Million Nine Hundred Ninety-Two Thousand Five Hundred Seventy-Two Dollars ($2,992,572.00). 3. REVISED COMPLETION DATE. Section 2.1 of the original Agreement between the parties is hereby amended to extend the Final Completion date to no later than September 30,2016 ("Revised Completion Date"). 4. OTHER PROVISIONS REMAIN IN EFFECT. Except as specifically modified herein, all terms and conditions of the original Agreement between the parties shall remain in full force and effect. 5. CONFLICTING PROVISIONS. The terms and conditions in this First Amendment supersede any conflicting provisions that are contained in any other document. If there is a conflict or inconsistency between any term, statement, requirement, or provision of this First Amendment and any term, statement, requirement or provision contained in any other document including but not limited to Attachment "A" and `B", the term, statement requirement, or provision contained in this First Amendment shall prevail and be given superior effect and priority.
