3. The amount paid for subsistence and travel required by collective <br /> bargaining agreements, or in accordance with the regular practice of the <br /> employer. <br /> 4. At the beginning of the extra Work and as later requested by the <br /> ENGINEER OF RECORD, the CONTRACTOR shall furnish the <br /> ENGINEER OF RECORD proof of labor compensation rates being paid. <br /> C. Materials: The cost of materials used in performing extra Work will be the cost to <br /> the purchaser, whether CONTRACTOR or subcontractor, from the supplier <br /> thereof, except as the following are applicable: <br /> 1. Trade discounts available to the purchaser shall be credited to the <br /> OWNER notwithstanding the fact that such discounts may not have been <br /> taken by the CONTRACTOR. <br /> 2. For materials secured by other than a direct purchase and direct billing to <br /> the purchaser, the cost shall be deemed to be the price paid to the actual <br /> supplier as determined by the ENGINEER OF RECORD. Markup except <br /> for actual costs incurred in the handling of such materials will not be <br /> allowed. <br /> 3. Payment for materials from sources owned wholly or in part by the <br /> purchaser shall not exceed the price paid by the purchaser for similar <br /> materials from said sources on extra Work items or the current wholesale <br /> price for such materials delivered to the Work site, whichever price is <br /> lower. <br /> 4. If in the opinion of the ENGINEER OF RECORD the cost of material is <br /> excessive, or the CONTRACTOR does not furnish satisfactory evidence <br /> of the cost of such material, then the cost shall be deemed to be the <br /> lowest current wholesale price for the quantity concerned delivered to the <br /> Work site less trade discount. The OWNER reserves the right to furnish <br /> materials for the extra Work and no claim shall be made by the <br /> CONTRACTOR for costs and profit on such materials. <br /> D. Equipment: The CONTRACTOR will be paid for the use of equipment as stated <br /> in the latest edition of the "Compilation of Rental Rates for Construction <br /> Equipment" by Associated Equipment Distributors. Such rental rate will be used <br /> to compute payments for equipment whether the equipment is under the <br /> CONTRACTOR's control through direct ownership, leasing, renting, or another <br /> method of acquisition. The rental rate to be applied for use of each item of <br /> equipment shall be the rate resulting in the least total cost to the OWNER for the <br /> total period of use. The CONTRACTOR may furnish cost data which might assist <br /> the ENGINEER OF RECORD in the establishment of the rental rate. <br /> 1. All equipment shall, in the opinion of the ENGINEER OF RECORD, be in <br /> good working condition and suitable for the purpose for which the <br /> equipment is to be used. <br /> I <br /> 00700-25/39 <br />
