ascertain the facts and the extent of the delay and extend the Contract times <br /> when, in its judgment, the findings of the fact justify such an extension. <br /> B. The CONTRACTOR shall base its construction schedule upon the inclusion of <br /> the number of days of inclement weather specified in paragraph entitled <br /> "Inclement weather delays" of the Supplementary General Conditions. No <br /> extension of the Contract Time due to inclement weather will be considered until <br /> after the said number of days of inclement weather has been reached. However, <br /> no reduction in Contract Time will be made if said number of days of inclement <br /> weather is not reached. <br /> ARTICLE 13 -- WARRANTY AND GUARANTEE; TESTS AND INSPECTIONS; CORRECTION, <br /> REMOVAL, OR ACCEPTANCE OF DEFECTIVE WORK <br /> 13.1 WARRANTY AND GUARANTEE <br /> A. The CONTRACTOR warrants and guarantees to the OWNER and the <br /> ENGINEER OF RECORD that all Work will be in accordance with the Contract <br /> Documents and will not be defective. Prompt notice of defects known to the <br /> OWNER or ENGINEER OF RECORD shall be given to the CONTRACTOR. All <br /> defective Work, whether or not in place, may be rejected, corrected, or accepted <br /> as provided in this Article 13. <br /> 13.2 ACCESS TO WORK <br /> A. The ENGINEER OF RECORD, other representatives of the OWNER, testing <br /> agencies, and governmental agencies with jurisdictional interests shall have <br /> access to the Work at reasonable times for their observation, inspections, and <br /> testing. The CONTRACTOR shall provide proper and safe conditions for such <br /> access. <br /> 13.3 TESTS AND INSPECTIONS <br /> A. The CONTRACTOR shall give the ENGINEER OF RECORD timely notice of <br /> readiness of the Work for all required inspections, tests, or approvals. <br /> B. If Laws or Regulations of any public body having jurisdiction other than the <br /> OWNER require any Work to specifically be inspected, tested, or approved, the <br /> CONTRACTOR shall pay all costs in connection therewith. The CONTRACTOR <br /> shall also be responsible for and shall pay all costs in connection with any <br /> inspection or testing required in connection with the OWNER's or the ENGINEER <br /> OF RECORD's acceptance of a Supplier of materials or equipment proposed as <br /> a substitution or (or-equal) to be incorporated in the Work, or of materials or <br /> equipment submitted for review prior to the CONTRACTOR's purchase thereof <br /> for incorporation in the Work. The costs of all inspections, tests, and approvals in <br /> addition to the above which are required by the Contract Documents shall be <br /> paid by the OWNER (unless otherwise specified).
