13.4 OWNER MAY STOP THE WORK <br /> A. If the Work is defective, or the CONTRACTOR fails to perform Work in such a <br /> way that the completed Work will conform to the Contract Documents, the <br /> OWNER may order the CONTRACTOR to stop the Work, or any portion thereof, <br /> until the cause for such order has been eliminated; however, this right of the <br /> OWNER to stop the Work shall not give rise to any duty on the part of the <br /> OWNER to exercise this right for the benefit of the CONTRACTOR or any other <br /> party. <br /> 13.5 CORRECTION OR REMOVAL OF DEFECTIVE WORK <br /> A. If required by the ENGINEER OF RECORD, the CONTRACTOR shall promptly, <br /> either correct all defective Work, whether or not fabricated, installed, or <br /> completed, or, if the Work has been rejected by the ENGINEER OF RECORD, <br /> remove it from the site and replace it with non-defective Work. The <br /> CONTRACTOR shall bear all direct, indirect and consequential costs and <br /> damages of such correction or removal, including but not limited to fees and <br /> charges of ENGINEER OF RECORDs, architects, attorneys, and other <br /> professionals made necessary thereby. <br /> 13.6 ONE YEAR CORRECTION PERIOD <br /> A. If within one year after the date of Substantial Completion or such longer period <br /> of time as may be prescribed by Laws or Regulations or by the terms of any <br /> applicable special guarantee required by the Contract Documents or by any <br /> specific provision of the Contract Documents, any Work is found to be defective, <br /> the CONTRACTOR shall promptly, without cost to the OWNER and in <br /> accordance with OWNER's written notification, either correct such defective <br /> Work, or, if it has been rejected by the OWNER, remove it from the site and <br /> replace it with non-defective Work. If the CONTRACTOR does not promptly <br /> comply with the such notification, or in an emergency where delay would cause <br /> serious risk of loss or damage, the OWNER may have the defective Work <br /> corrected or the rejected Work removed and replaced, and all direct, indirect, and <br /> consequential costs and damages of such removal and replacement including <br /> but not limited to fees and charges of ENGINEER OF RECORDs, architects, <br /> attorneys and other professionals will be paid by the CONTRACTOR. <br /> B. Where defective Work (and damage to other Work resulting there from) has been <br /> corrected, removed or replaced under Paragraph 13.6, the correction period <br /> hereunder, with respect to such Work will be extended for an additional period of one <br /> year after such correction or removal and replacement has been satisfactorily <br /> completed. <br /> 00700-32/39 <br />
