responsibility for the protection and maintenance of all such items or portions of <br /> the Work described in the written notice. <br /> C. The CONTRACTOR shall retain full responsibility for satisfactory completion of <br /> the Work, regardless of whether a portion thereof has been partially utilized by <br /> the OWNER and the CONTRACTOR's one year correction period shall <br /> commence only after the date of Substantial Completion for the Work. <br /> 14.7 SUBSTANTIAL COMPLETION <br /> A. When the CONTRACTOR considers the Work ready for its intended use the <br /> CONTRACTOR shall notify the OWNER and the ENGINEER OF RECORD in <br /> writing that the Work is substantially complete and request that the ENGINEER <br /> OF RECORD prepare a Certificate of Substantial Completion/Notice of <br /> Completion. Within a reasonable time thereafter, the OWNER, the <br /> CONTRACTOR, and the ENGINEER OF RECORD shall make an inspection of <br /> the Work to determine the status of completion. If the ENGINEER OF RECORD <br /> does not consider the Work substantially complete, the ENGINEER OF <br /> RECORD will notify the CONTRACTOR in writing giving the reasons therefor. If <br /> the ENGINEER OF RECORD considers the Work substantially complete, the <br /> ENGINEER OF RECORD will prepare and deliver to the OWNER for its <br /> execution and recordation the Certificate of Substantial Completion/Notice of <br /> Completion signed by the ENGINEER OF RECORD and CONTRACTOR, which <br /> shall fix the date of Substantial Completion. As applicable, there shall be <br /> attached to the Certificate/Notice a list of items to be completed or corrected <br /> before final payment. <br /> 14.8 FINAL APPLICATION FOR PAYMENT <br /> A. After the CONTRACTOR has completed all correction Work referred to in <br /> Paragraph 14.7 and delivered all maintenance and operating instructions, <br /> schedules, guarantees, Bonds, certificates of inspection, marked-up record <br /> documents (as provided in the General Requirements) and other documents, all <br /> as required by the Contract Documents, and after the ENGINEER OF RECORD <br /> has indicated that the Work is acceptable, the CONTRACTOR may make <br /> application for final payment following the procedure for progress payments. The <br /> final Application for Payment shall be accompanied by all documentation called <br /> for in the Contract Documents, together with complete and legally effective <br /> releases or waivers (satisfactory to the OWNER) of all liens arising out of or filed <br /> in connection with the Work. <br /> 14.9 FINAL PAYMENT AND ACCEPTANCE <br /> A. If, on the basis of the ENGINEER OF RECORD's observation of the Work during <br /> construction and final inspection, and the ENGINEER OF RECORD's review of <br /> the final Application for Payment and accompanying documentation, all as <br /> required by the Contract Documents, the ENGINEER OF RECORD is satisfied <br /> that the Work has been completed and the CONTRACTOR's other obligations <br /> under the Contract Documents have been fulfilled, the ENGINEER OF RECORD <br /> will, within fourteen (14) days after receipt of the final Application for Payment, <br /> 00700-35/39 <br /> S <br />
