Summary Minutes:Regular City Commission Meeting March 17.2016 City or Sunny Isles Beach.Florida <br /> Clerk Hines read the title, and Mayor Scholl reported that the developer that owns the Corner <br /> House property at the entrance to Golden Shores,agreed to donate that property to the City in <br /> exchange for TDRs,this is the method of acquiring park lands. We get a property owner that <br /> agrees to donate something in exchange for TDRs. It works exceptionally well with <br /> developers that own property because they have a use for the TDRs on their oceanfront <br /> developments. In this case, what often happens is when we agree to accept the piece of land <br /> for TDRs, the prior owner still has a use for it and so we make a deal and say okay you can <br /> still occupy the land for three years, and this is what we did in the south end of the City at the <br /> entrance to Arlen House. In this case this developer is building right across the street from <br /> the Arlen House, the Ritz-Carlton Residences. \Ve made a deal with the developer that we <br /> agree to lease the property on the south end of the City and they asked us if we would <br /> consider extending that lease for 18 months under certain conditions meaning if they still <br /> need it for Ritz-Carlton Sales Office. The trade-off here was we get the piece at the entrance <br /> of Golden Shores immediately. At the Commission meeting where we approved the <br /> acceptance of that property for TDRs, as soon as that was closed the City Attorney had the <br /> deed to that property and the City is already occupying it. Instead of having two (2) pieces <br /> tied up for three (3) years, what we agreed to do was, to tie up one piece a little longer under <br /> certain conditions and get the piece that we just recently were deeded immediately. That was <br /> the genesis behind these two leases, and so we are agreeing to allow the developer from the <br /> north end of the City to lease the property from the developer on the south end of the City. <br /> Public Speakers: Larisa Svechin <br /> A resident of Golden Shores, Larisa Svechin,said thank you to the Commission on behalf of <br /> the residences at Golden Shores, for what they did with the Corner House property. <br /> Commissioner Aelion moved and Vice Mayor Gatto seconded a motion to approve the <br /> resolution. Resolution No. 2016-2533 was adopted by a voice vote of 5-0 in favor. <br /> IOD. A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Approving a <br /> Triple Net Leaseback Agreement with Corner House, LLC for the Property Located at <br /> 15800 Collins Avenue, Attached Hereto as Exhibit "A"; Authorizing the Mayor to Execute <br /> Said Agreement; Authorizing the City Manager and City Attorney to Do All Things Necessary <br /> to Effectuate this Resolution; Providing for an Effective Date. <br /> (Deferred from 02/18/16) <br /> Action: [City Clerk's Note: Item IOD and related Item IOC were heard together.] City <br /> Clerk Hines read the title, and Mayor Scholl reported that we are agreeing to that 18-month <br /> extension under certain conditions. Those conditions are: if they are sold out of the Ritz- <br /> Carlton Residences in a couple of years, they won't have the right to continue to lease that <br /> property and we will get it back. If they are still selling Ritz-Carlton Residences they will <br /> still be using that as a Sales Office, and they will have a right for an additional 18 months. <br /> Public Speakers: Larisa Svechin <br /> Commissioner Aelion moved and Vice Mayor Gatto seconded a motion to approve the <br /> resolution.
