A Resolution of the City Commission of the City of Sunny Isles Beach,Florida,Approving <br /> an Interlocal Agreement with Miami-Dade County for the Municipal Parking Fines <br /> Reimbursement Program,Attached Hereto as Exhibit"A";Authorizing the City Manager <br /> to Execute Said Agreement; Authorizing the City Manager to Do All Things Necessary to <br /> Effectuate this Resolution; Providing for an Effective Date. <br /> Action: City Clerk Hines read the title, and City Manager Russo reported noting this is a <br /> routine renewal where we share in the revenue from handicapped parking funds. All the <br /> revenue must be used for the approval of accessibility in the City. <br /> Public Speakers: None <br /> Commissioner Levin moved and Vice Mayor Gatto seconded a motion to approve the <br /> resolution. Resolution No. 2016-2561 was adopted by a voice vote of 5-0 in favor. <br /> 10C. A Resolution of the City Commission of the City of Sunny Isles Beach,Florida,Authorizing <br /> a Code Enforcement Lien Amnesty Program; Authorizing the City Manager and the City <br /> Attorney to Do All things Necessary to Effectuate the Terms of this Resolution;Authorizing <br /> the City Manager and City Clerk to Publish Notice of the City's Code Enforcement Amnesty <br /> Program in the City's Website,Newspaper,and Other Publishing Mediums;Providing for an <br /> Effective Date. <br /> Action: City Clerk Hines read the title, and Commissioner Goldman reported that based on <br /> conversations with residents over the years, she learned that many residents may not be <br /> aware of all the rules and regulations of the City. Due to this some residents may have <br /> engaged in conduct by mistake that may be in violation of the City Code which leads to the <br /> imposition of code enforcement liens against their property. Since Code Enforcement is a <br /> remedial tool, instead of a punitive tool, she asked the Commission to approve a temporary <br /> Code Enforcement Lien Amnesty Program. Under this program, residents or any violator <br /> can seek a reduction of the outstanding lien amount to 15% of the total amount of the lien, <br /> provided that compliance is achieved. At this time, the majority of code enforcement liens <br /> are settled at 25%of the total amount of the lien. Presently the City has 91 outstanding code <br /> enforcement liens that were imposed at previous Special Master Hearings. The City has the <br /> authority to foreclose on the liens or release the code enforcement liens depending on <br /> whether compliance is obtained and fines are paid. By instituting this program the City can <br /> more easily obtain settlement of the currently outstanding code enforcement liens. She <br /> thinks the key here is that Code Compliance and Code Enforcement is really about policy of <br /> compliance and really not used as punishment to impose heavy liens. We just want to see <br /> that people bring their properties up to compliance and that the City really keep pace with <br /> that and not use this whole penalty and lien enforcement process as punishment rather than <br /> what it really should be which is a policy. <br /> Public Speakers: None <br /> Commissioner Levin said as a Real Estate Attorney and a Title Attorney, she deals with these <br /> types of issues all the time where there are liens filed against properties and sometimes they <br /> can be in the thousands or hundreds of thousands of dollars because they accrue at such high <br /> amounts some times, and she thinks this is a great program where people come in and <br /> 5 <br />
