Vera, Assistant City Manager / Service Division <br /> <br />DATE: <br /> <br />5/20/2010 <br /> <br />RE: <br /> <br />Extension of Time for Transfer of Develoment Rights <br /> <br />RECOMMENDATION: <br /> <br />This Resolution is presented for your consideration. <br /> <br />REASONS: <br /> <br />Pursuant to Resolution No. 2009-1398, adopted March 19, 2009, any owner of privately <br />owned development rights ("TDRs") acquired pursuant to Section 265-23 of the Land <br />Development Regulations may request up to a (10) year extension to utilize development <br />rights purchased by a private party upon an annual payment fee. <br /> <br />Fort Apache Marina, LLC. is requesting an extension of the TDRs in the amount of 19 <br />units and 34,484 square feet of floor area for a 10 year period. The property owner shall <br />pay $2,741 annually in order to preserve the development rights stated above and must <br />pay this amount each year in order to preserve the development rights. This extension <br />does not create any vested rights with respect to the development rights. <br /> <br />A TT ACHMENTS: <br />.
