<br />Section 4. <br /> <br />so that the light source or any reflective surface of the light <br />is not visible from the beach; <br />IV. That cannot be bought into compliance '.'/ith the provision <br />of these standards. <br /> <br />F. Publicly-owned lighting. Streetlights, existing lighting at parks, publicly owned <br />parking facilities and publicly owned walkways shall be subjected to the <br />following: <br /> <br />(1) Lighting at parks, publicly owned parking facilities and publicly owned <br />walkways shall be shielded or shaded during nighttime hours of nesting <br />season so that such lighting does not illuminate the beach and visibility is <br />reduced from the beach. Such shielding or shading shall not create a <br />safety hazard for pedestrians. <br /> <br />G. Unlawful to kill, molest, or injure turtles. In accordance with F.S. Ch. 370 and <br />the U.S. Endangered Species Act of 1973, it shall be unlawful for any person to <br />kill, molest, harass, or cause direct or indirect injury to a species of marine turtle <br />in the City of Sunny Isles Beach or within its jurisdictional waters. It shall be <br />unlawful to collect or possess any part of a marine turtle, turtle nest and/or egg( s). <br />The City of Sunny Isles Beach will cooperate with appropriate state and federal <br />agencies in prosecuting violations of the Act. <br /> <br />Enforcement and Penalties. <br /> <br />(a) The provisions of this Ordinance shall be enforced in accordance with <br />Chapter 14 of the Code of the City of Sunny Isles Beach. The <br />Community Development Department shall be responsible for the <br />enforcement of the provisions of this Ordinance. <br />(b) Other person or persons responsible for lighting or management of the <br />property may also be served with notice if determined appropriate by the <br />city administration. Upon refusal, failure or neglect of the person or <br />persons served with a notice of violation to cure the violation within ten <br />days of such notice, or when the violator or the violator's representatives <br />do not appear at the hearing granted pursuant to this Code, or when an <br />order finding a violation is entered against the violator, the enforcing <br />agency shall notify the property owner, in writing, ofthe extemallighting <br />source causing the violation, and possible liens that may be imposed until <br />compliance is obtained. <br />(c) No permit may be issued by the City of Sunny Isles Beach to improve or <br />expand any facility constructed or modified in violation of this Ordinance <br />until the violation has been corrected, and all associated code <br />enforcement fees are collected. <br />(d) Violations of this section shall be deemed an infraction and subject to <br /> <br />6 <br />
