<br />RESOLUTION NO. 97-Z-5 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES <br />BEACH, FLORIDA, APPROVING ADMINISTRATIVE NON-USE VARIANCE <br />APPLICATION OF EVELIO ACOSTA; PROVIDING FOR APPEAL. <br /> <br />WHEREAS, Evelio Acosta has applied for the following: <br /> <br />(1) Administrative approval for a non-use variance oflot coverage requirements to <br />permit a proposed addition porta cochere to allow setback at 12.5' from the front <br />where 25' is required, and; <br /> <br />(2) A non-use variance lot coverage requirement to permit a residence with a lot <br />coverage of38% (35% required) <br /> <br />Location: 300 Atlantic Avenue, Sunny Isles Beach. <br /> <br />WHEREAS, at a public hearing of the City Commission of the City of Sunny Isles Beach, <br />Florida, was held and all interested parties concerned in the matter were heard; <br /> <br />WHEREAS, the City Commission has been advised by Dade County that the subject <br />application has been reviewed for compliance of procedural requirements for administrative <br />variances in Section 33-36.1 ofthe Dade County Code, as adopted by the City of Sunny Isles Beach; <br /> <br />WHEREAS, the Commission finds the following exists: <br /> <br />(1) that the variance will be in harmony with the general appearance and <br />character of the community; <br /> <br />(2) the variance will not be injurious to the area involved and otherwise <br />detrimental to the public welfare; <br /> <br />(3) that the proposed addition is designed and arranged on the site in a manner <br />that does minimize aural and visual impact on the adjacent residences while <br />affording the applicant reasonable use of this land. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA THAT THE REQUESTED NON-USE VARIANCES BE <br />AND THE SAME, ARE HEREBY APPROVED. <br /> <br />PASSED AND ADOPTED this 20th day of November, 9, 7. <br /> <br />
