<br />RESOLUTION NO. 99-Z-31 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING <br />THE REQUEST OF INTERCOASTAL YACHT CLUB FOR: (1) <br />MODIFICATION OF CONDITION #lC OF RESOLUTION <br />NO. 98-Z-8 PASSED AND ADOPTED BY THE CITY <br />COMMISSION OF THE CITY OF SUNNY ISLES BEACH ON <br />MAY 28, 1998 AND (2) NON-USE VARIANCE OF <br />ADMINISTRATIVE PROCEDURE, SUBJECT TO CERTAIN <br />CONDITIONS; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, Intercoastal Yacht Club, trust owner, has applied for the following: <br /> <br />I. Modification of condition # I C of Resolution 98-Z-8 passed and adopted by the City <br />Commissioners of the City of Sunny Isles Beach on May 28, 1998 reading as follows: <br /> <br />From #2: <br /> <br />That in the approval of the plan, the same be substantially in accordance with <br />that submitted for the hearing entitled "Intercoastal Yacht Club Apartments", <br />prepared by Salvador M. Cruxent/ Architect dated revised February 26, 1998 <br />sheets 1 thru 5 and 7 and dated revised January 19, 1998 on sheets 6 and 9 <br />and dated revised January 22, 1998 on sheet 8. <br /> <br />To # 2: <br /> <br />That in the approval of the plan the same be substantially in accordance with <br />that submitted for the hearing entitled "Intercoastal Yacht Club Apartments" , <br />prepared by Salvador M. Cruxent/Architect dated revised March 15, 1999 <br />sheet A 1.1 and dated revised March 12, 1999 on sheetsA2- 3, A2-7, A2-11, <br />A2-16, A3-1, A4-4, A4-5, A4-6, A4.7 <br /> <br />The purpose of this request is to allow the applicant to substitute existing plans to show an increase <br />in the previously approved number of units and an increase in height of two of the three buildings <br />closest to Sunny Isles Blvd. <br /> <br />2. Non-use variance of Administrative Procedure to permit the calculation of net density to <br />include the transfer of development rights from 4.6 acre of privately owned and zoned (RU- <br />4A) submerge land. <br /> <br />SUBJECT PROPERTY: <br /> <br />Tract "A" of THE PARTHENON, according to the plat thereof, as recorded in Plat Book <br />116, at Page 21, of the Public Records of Dade County, Florida, <br /> <br />R99-Z-31, Intercoastal Yacht Club <br /> <br />-1- <br />
