RESOLUTION NO 00-Z-4l A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE REQUEST 18100 COLLINS AVENUE SHOPPING CENTER, LTD., FOR A DISTRICT BOUNDARY CHANGE FROM BU-lA AND BU-l TO BU-3, SUBJECT TO CERTAIN CONDITIONS; PROVIDING AN EFFECTIVE DATE. WHEREAS, 18100 Collins Avenue Shopping Center, Ltd., has applied for the following: 1. District Boundary Change from BU-IA and BU-l to BU-3 SUBECT PROPERTY: The north 150 ft of Parcell, as measured along the east line thereof of Parcel 1 of Replat of Tract "A" Sunny Isles Shores Section "A" PB 64 PG 74 AND Parcel 2 Replat of Tract "A" Sunny Isles Shores Section "A" PB 64 PG 74 . ADDRESS: Lying south of 183 St. between Collins Ave. and Atlantic Blvd. And, WHEREAS, a public hearing of the City Commission was advertised and held as required by law and all interested parties concerned in the matter were heard, and upon due and proper consideration having been given to the matter; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, THAT: 1. The Applicant's request for a district boundary change from BU-IA and BU-l to BU-3 is hereby approved subject to the following conditions: a. That applicant proffers a Declaration of Restrictions, acceptable to the City, restricting the uses permitted on the property. b. That the applicant be permitted only the following uses on the property: All uses permitted in BU-l, BU-IA and BU-2 districts (except that residential uses shall not be permitted), automobile rentals (limiting storage of auto for rental to 10), bakeries, retail and wholesales, dry cleaning and dyeing establishments, locksmith, television and broadcasting station, including studio and transmitting station. c.
