<br />RESOLUTION NO. 00-Z-51 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, DENYING THE APPLICATION OF <br />ARLEN HOUSE EAST CONDOMINIUM ASSOCIATION, ET AL., <br />APPEALING THE ADMINISTRATIVE DECISION OF THE ZONING <br />DIRECTOR (ASPR99-0l) FOR SITE PLAN REVIEW; PROVIDING FOR <br />AN EFFECTIVE DATE. <br /> <br />WHEREAS, on May 11, 2000, Arlen House East Condominium Association, et al <br />("Applicant"), applied for an appeal of Administrative Decision ASPR 9901 of the Zoning <br />Director on the grounds that the Director erred in his decision approving a site plan for an <br />apartment development; <br /> <br />LEGAL <br /> <br />All of Lots 17 and 18, Bay Point Subdivision, according to the plat thereof as <br />recorded in Plat Book 46 Page 98 of the Public Records of Dade County, Florida, <br />and a portion of the south 50 feet of Lot 82 of Tatum's Ocean Beach Park, <br />recorded in Plat Book 5, at Page 35, Dade County, Florida, all being more <br />particularly described as follows: <br /> <br />Begin at the Southwest comer of said Lot 18; thence on a bearing of North along <br />the westerly lines of Lots 17 and 18, said westerly line also being the Easterly <br />line of Tract A, Arlen House East, according to the plat thereof as recorded in <br />Plat Book 97, page 5 of the Public Records of Dade County, Florida for 205.95 <br />feet to the Northwest comer of said LotI 7; thence North 59059'22" East along the <br />northwesterly line also being Dade County Bulkhead line according to the plat of <br />Royal Palm Waterway as recorded in Plat Book 74, page I, sheet of the Public <br />Records of Dade County, Florida for 62.16 feet to the most northerly recorded <br />point of said Lot 17; the following course being along a line parallel with and 50 <br />feet North of the South line of said Lot 82, Tatum's Ocean Beach Park, said <br />South line also being the North line of Lot 17; thence North 85051'44" East for <br />79.79 feet to a point on the westerly right of way line of State Road A-I-A <br />(Collins Ave) as shown on the said plat of Bayview Point Subdivision; thence on <br />a bearing of South along said westerly right of way line also being the easterly <br />lines of said Lots 17 and 18 and its northerly projection thereof for 200.01 feet to <br />a point of curvature; thence southwesterly along a 25.00 foot radius curve leading <br />to the right through a central angle of 80051 '00" for an arc distance of 35.38 feet <br />to a point of tangency; thence South 80051'00" West along the southerly line of <br />said Lot 18, said southerly line also being the northerly right of way line of <br />Bayview Drive as shown on said plat of Arlen House East for 113.83 feet to the <br />Point of Beginning.
