<br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SllNNY ISLES BEACH, FLORIDA, APPLICABLE TO APPLICANT, ITS <br />SUCCESSORS OR ASSIGNS, AS FOLLOWS: <br /> <br />II. INCORPORATION OF RECITALS. <br /> <br />All recitals are incorporated into the body of this Resolution as i I' same were fully set forth herein. <br /> <br />III. APPROV ALS. <br /> <br />The approvals set forth In this Section [II are subject to all of the conditions set forth in this <br />Resolution, <br /> <br />1. The Applicant's request for approval of the modification of a previously approved site plan <br />approved under Resolution No, 03-Z-75, passed and adopted on July ] 7. 2003. for the <br />Project known as "Regalia:' is hereby granted and the modi fied site plan is hereby <br />approved. subject to all of the conditions provided herein. including but not limited to those <br />conditions set forth in Section IV of this Resolution, The failure of performance of any of <br />these conclitions shall be deemed a denial of this Application, <br /> <br />2. The request to repeal Resolution No, 2006-890. passed and adopted on February 16,2006, is <br />hereby approved, <br /> <br />IV. CONDITIONS <br /> <br />A. Conditions to he completcd hcfoJ'e helow grade 01' building pcrmits, including <br />foundation pCI'mits, arc issued or construction of any naturc is commcnced. <br /> <br />1. That the Project shall be developed substantially in accordance \vith the plans submitted for <br />the July 20. 2006. public hearing for "Regalia LLC" and on file with the City's Planning & <br />Zoning Department and Building Department entitled "Regalia. LLC" prepared by <br />Arquitectonica. consisting of 11 sheets dated stamped received 6-21-06 and plans entitled <br />"Boundary Survey" consisting of four (4) sheets prepared by "Fortin Leavy. Skiles, Inc.", <br />dated stamped received 06-21-06, Plans may be modified at public hearing, <br /> <br />2. That a revised plot plan be submitted to the City's Director of Planning & Zoning and the <br />Building Department. Landscape Architect and Planning Consultant including their in-house <br />experts. for their revinv, The plot plan shall include all easements proffered by the <br />Applicant to the City. exactly as represented to the City Commission by site plan drawing <br />and oral representation at the public hearing. including but not limited to (i) a beach access <br />easement located on the northern edge of the property (the "North Beach Access Easement"), <br />(ii) a beach access easement along the south property line as represented by the Applicant to <br /> <br />"l <br />,1 <br /> <br />Regalia Reso, 200iJ <br />
