<br />9. No building permits shall be issued (except for demolition and sales trailers) unless the <br />Applicant has submitted all documents referred under this approval and shall have paid <br />all impact fees, bonuses and Transfer of Development Rights (if applicable), professional <br />fees (as per Chapter 267 of the Code of the City of Sunny Isles Ordinance) have been <br />paid. <br /> <br />10. That the proposed Project be developcd substantially in compliance with the plans <br />submitted at the hearing, with specific attention to be given to compliance with the <br />requirements regarding the exterior lighting for the Project. <br /> <br />II. Within three (3) business days of approval of the zoning application by the city <br />Commission, the Applicant shall provide the City with a deposit in the amount of <br />$103,000.00 for the transfer of 1,815 square feet and I dwelling unit, from the City's <br />TDR Bank, subject to an appraisal being obtained by the City. If the full purchase price <br />based on the appraisal is less than the total amount deposited by the Applicant, the <br />Applicant is entitled to a refund of the difference between the final price and the total <br />amount deposited. In the event that the appraisal is higher than the total amount <br />submitted by the Applicant, then the Applicant shall deposit the difference. <br /> <br />12. The Applicant agrees to contribute Five Hundred Thousand Dollars ($500,000) ( the <br />"Applicant's Monetary Contribution") for the design and construction of a decorative <br />facade, bay-walk or boardwalk, and any other improvcment around the Miami-Dade <br />County's Sewage Pump Station located on Sunny Isles Beach Boulevard. The <br />Applicant's Monetary Contribution shall be paid prior to the issuance of a building <br />permit. <br /> <br />Conditiolls to bc eomuleted before allV Certificate of Oeeupanev is issued <br /> <br />1. That the Applicant demonstrates that it is in compliancc with all terms and conditions <br />under this approval. <br /> <br />2. Applicant shall pay all fees rclated to the review of the application described herein and <br />shall have paid all other fees due to the City. <br /> <br />3. Pursuant to Section 267-4 of the Code of the City of Sunny Isles Beach, the City <br />Manager and lor his/her designee in review of any application, may refer any such <br />application presented to it to such engineering, planning, legal, technical, or <br />environmental consultant or professional(s) employed by the City as the Manager shall <br />deem reasonably necessary to enable him/her to review such application as required by <br />law. Charges made by such consultants or professionals shall be in accord with the <br />charges customarily made for such services in Miami Dade County, and pursuant to an <br />existing contractual agreement by and between the City and such consultant.
