<br />RESOLUTION NO. 06-Z-ill <br /> <br />A RESOLUTION OF TilE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, ("CITY") APPROVING TilE <br />ZONING APPLICATION SUBMITTED BY SUNNY ISLES RESORT <br />DEVELOPERS, LLLP., (TilE "APPLICANT"), (Z2006-08) FOR <br />TRANSFER OF DEVELOPMENT RIGHTS ("TORs"), IN THE AMOUNT <br />OF 51,749 SQUARE FEET OF FLOOR AREA OF TWENTY FIVE (25) <br />DWELLING UNITS, PURSUANT TO SECTION 265-23 OF THE CITY'S <br />LAND DEVELOPMENT REGULATIONS (LDR's), AND SITE PLAN <br />APPROVAL PURSUANT TO SECTION 265-18 OF THE LOR's, TO <br />PERMIT THE DEVELOPMENT OF "OCEAN BEACH RESORT", A 32 <br />STORY, 103 UNIT CONDOMINIUM PRO,IECT, ON THE PROPERTY <br />LOCATED AT 17475 COLLINS A VENUE, SUB.lECT TO CERTAIN <br />CONDITIONS; AND PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />I. RECITALS. <br /> <br />WHEREAS, on August 7, 2006, SUNNY ISLES RESORT DEVELOPERS, LLLP., (the <br />"Applicant") submitted an application to the City of Sunny Isles Beach, Florida ("the <br />Application") (Z2006-08), requesting the following: <br /> <br />I. Pursuant to Section 265-18 of the City of Sunny Isles Bcach Land Development <br />Regulations. thc applicant is requcsting a site approval for 32 stories, 103 unit <br />condominium. <br /> <br />2. Pursuant to Section 265-23 of the City of Sunny lslcs [leach Land Developmcnt <br />Regulations the applicant is rcqucsting the transfer of tifty-onc thousand seven hundred <br />forty-nine (51,749) square fcct and twenty-five (25) units dcvelopment rights from thc <br />City's Transfer of Development Rights Bank ("Bank"). (An adjustmcnt to be madc for a <br />decrcase of 51,749 square feet and twenty-eight (28) dwelling units li'om the City's <br />Transfer Development Rights Bank). <br /> <br />3. Pursuant to Section 265-35 (D) (8) of the City of Sunny Isles Beach Land Development <br />Regulations, the applicant is requesting a waiver of the Beach Acccss Eascment required <br />under the Land Development Regulations. <br /> <br />4. Pursuant to Section 265-46 (A) (4) of the City of Sunny Isles Bcach Land Development <br />Regulations, the applicant is requesting to permit 38% tandem parking, other than <br />handicapped parking (20% tandem parking permittcd). <br /> <br />5. The applicant is requesting a variance Ii'om Section 265-35D (4) (c) [2][b] of the City of <br />Sunny Isles Beach Land Dcvelopment Regulations permitting the pcdestal to be setback to <br />zero (0'- 0") feet on the north side (12'-0") fcet is required. <br /> <br />Plans are on file and may be examined in the Planning and Zoning Departmcnt entitled <br /> <br />R06-Z- <br /> <br />Ocean Beach Resort <br />
