<br />ADDRESS: 16800 Collins A venuc <br /> <br />WHEREAS, on June 21, 2007, the City Commission conducted a public hearing on thc <br />application submitted by Applicant; and <br /> <br />WHEREAS, the public hearing of the City Commission was advcrtised and held as <br />required by law, all intercsted parties concerned in the matter were hcard, and due and proper <br />considcration was given to thc matter and to the positive recommendation containcd in thc joint <br />memorandum from thc Planning and Zoning Administrator and the Planning Consultant; and <br /> <br />WHEREAS, notice was provided to all interested parties regarding the Application. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITV COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, APPLICABLE TO APPLICANT, ITS <br />SUCCESSOR OR ASSIGNS, AS FOLLOWS: <br /> <br />II. INCORPORATION OF RECITALS. <br /> <br />All recitals arc incorporated into the body of this Resolution as if same wcre fully set forth <br />herein. <br /> <br />III. APPROVALS. <br /> <br />The approvals set forth in this Section are subject to All of the conditions set forth in this <br />Resolution. <br /> <br />A. The City Commission hereby approvcs thc sIgn vanance requested by MOTlV A <br />ENTERPRISES, LLC. <br /> <br />IV. OTHER CONDITIONS. <br /> <br />(I) That thc approval shall remain val id for a period of 24-months from the datc of approval. <br />If no building permit is issued within thc 24-month time period, the site plan shall bc <br />considered null and void and of no force and cffect. Developcr may request extension in <br />accordance with Code Section 265-2(b) (6). <br /> <br />(2) That the Applicant shall comply with all City Ordinances applicable to development and <br />permit approvals. <br /> <br />FAILURE BY THE CITY TO TIMELY ENFORCE ANY OF THE ABOVE <br />CONDITIONS DOES NOT CONSTITUTE A WAIVER OF TIlE SAME IF THE <br />APPLICANT, ITS SUCCESSORS,OR, ASSIGNS, DOES NOT PERFORM SUCH <br />CONDITIONS WITHIN FIVE (5) DAYS AFTER WRITTEN NOTICE, THE CITY <br />RETAINS THE RIGHT TO STOP CONSTRUCTION, IF NECESSARY, UNTIL THAT <br />CONDITION IS MET.
