Dannhelsser, City Attorney ~ <br />December 18,2003 <br /> <br />AMENDMENT TO TDR ORDINANCE <br /> <br />This amendment to the TOR ordinance clarifies the requirements for a complete <br />application with a transfer for development rights. Specifically, it allows for the <br />consolidation of the site plan review process and the transfer of development rights, if <br />so approved by the City Commission, so that both may be accomplished at the same <br />time without the necessity of the presently bifurcated process. <br /> <br />On privately owned sender sites that will be conveyed to the City after the transfer of <br />TORs to another privately owned site, the amendment allows the City to erect public <br />parking garages to serve the Town Center, permits development of public educational <br />facilities and/or the construction by the City of other essential public facilities. It also <br />specifies the manner of conveyance of privately owned sites is by Warranty Deed as <br />opposed to easement. <br /> <br />Finally, included in this amendment is the proposal by Commissioner Thaler that no one <br />applicant for transferable development rights may be permitted to purchase from the <br />City more than 50,000 square feet from the TOR's remaining in the City "bank" and <br />further providing that no less than 100,000 square feet of transferable development <br />rights shall remain in the bank for future use by and for City designated purposes for the <br />City's benefit. This takes into account the fact that the City may have future <br />unanticipated, or presently unforeseeable, needs and reserves these rights for City <br />designated purposes rather than present income for the City. <br /> <br />Please note that while you will see a great deal of underlining in this ordinance which <br />would normally indicate revisions, much of that underlining (apart from what I have <br />specifically mentioned in this ordinance), pertains to a reorganization of the legislation <br />for better clarity and ease of reference.
