<br />CITY OF SUNNY ISLES BEACH 2007 COMPREHENSIVE PLAN <br />EVALUATION AND APPRAISAL REPORT (EAR)-BASED AMENDMENTS <br /> <br />* * * <br /> <br />33. Amend Policy 158. to include include interpretive text for the Water and the Community Facilities <br />designation, to be inserted after the interpretive text for the Neighborhood Business designation. Please note <br />that both Water and Community Facilities are identified on the Future Land Use Map, but there is currently no <br />corresponding interpretive text. The proposed text for the Community Facilities District is consistent with the <br />existing Land Development Regulations. <br /> <br />* * * <br /> <br />Water <br /> <br />The areas that are designated Water on the Future Land Use map reflect natural and man-made water bodies <br />within the City. These areas provide numerous benefits to the City of Sunny Isles Beach and are an important <br />component of the City's multi-modal transportation network, stormwater drainage infrastructure, and natural <br />and built environments. The use of these areas shall be limited to: recreational and commercial boating <br />facilities and uses (including water taxis and ferries); the provision of open space and urban relief; recreation; <br />waterways; wetlands; flood control; storm water drainage and storage, and; natural resource protection and <br />enhancement. The use of these areas shall comply with the requirements of Chapter 24, "Environmental <br />Protection...", of the Miami-Dade County Code of Ordinances, the South Florida Water Management District's <br />Environmental Resource Permit criteria, and State criteria for use of sovereign submerged lands. Development <br />in or above areas designated "Water" that will diminish these functions shall be prohibited, and development <br />and redevelopment adiacent to these areas shall include provisions to enhance these functions where <br />appropriate. Submerged lands shall not be used for density or intensity calculations unless such lands are within <br />the boundaries of a platted lot. <br /> <br />Community Facilities <br /> <br />The Community Facilities District indicates the location of: federal, State and local government facilities; <br />public health facilities; recreational, cultural, religious, and/or educational uses; transportation facilities; public <br />facilities and utilities; residential care facilities, and; similar uses that generally serve and benefit the <br />community. Up to 25 dwelling units per acre are permitted for residential care facilities. The maximum FAR <br />for non-residential uses is 2.0. <br /> <br />* * * <br /> <br />34. Amend Policy 15C. as follows: <br /> <br />Policy 15C. The City of Sunny Isles Beach shall adept continue to utilize innovative land development <br />regulations wffieh to implement the Goals, Objective and Policies of the Comprehensive Plan. Such regulations <br />shall include Transferable Development Rights (TOR) regulations in accordance with the following standards: <br /> <br />a) Receiver and sender districts shall be established designated in appropriate areas, except that with <br />receiver districts shall-limited to locations within the Town Center, Mixed-Use-High Density/Resort, <br />Mixed Use-Business, and Neighborhood Business land use categories. <br /> <br />b) Mechanisms to enhance the value and marketability of TDRs shall be established utilized, such as <br />assigning density bonuses to receiver sites which may exceed the future land use category density <br />limitations set forth in Policy 15B... <br /> <br />13 <br />
