<br />CITY OF SUNNY ISLES BEACH 2007 COMPREHENSIVE PLAN <br />EV ALUATION AND APPRAISAL REPORT (EAR)-BASED AMENDMENTS <br />The Transportation Element is amended to address: Issue 2, "Transportation Improvement; update dates, <br />timelines, and planning horizons, as needed, and; address growth management legislation enacted since the date <br />of plan adoption. <br /> <br />The Housing Element is amended to address: Issue 4, "Affordable Housing", and; to update dates, timelines, <br />and planning horizons, as needed. <br /> <br />The Recreation and Open Space Element is amended to update Objective 5 to reflect the current status of the <br />City's parks program. <br /> <br />The Capital Improvements Element is amended to address: Issue 1, "Land Development"; update dates, <br />timelines, and planning horizons, as needed, and; address growth management legislation enacted since the date <br />of plan adoption. <br /> <br />The Coastal Management Element is amended to update dates and references, as appropriate. <br /> <br />The Infrastructure Element is amended to address growth management legislation enacted since the date of plan <br />adoption. <br /> <br />The optional Community Design Element is recommended for deletion because its goals, objective and policies <br />are .duplicative of, and more effectively addressed within, the Future Land Use Element, and/or are no longer <br />applicable or appropriate. <br /> <br />The Conservation Element is amended to address growth management legislation enacted since the date of plan <br />adoption, and to include Policy calling for the removal of non-native vegetation. <br /> <br />The Intergovernmental Coordination Element is amended to address: Issue 3, "Intergovernmental <br />Coordination"; update dates, timelines, and planning horizons, as needed, and; address growth management <br />legislation enacted since the date of plan adoption. <br /> <br />The Monitoring & Evaluation Provisions section is amended to reflect the current EAR process requirements <br />and timelines. <br /> <br />2. Objections, Recommendations and Comments Report <br /> <br />The City approved transmittal of its EAR-Based Amendments to the Department of Community Affairs for <br />preliminary sufficiency review upon first reading of the adopting Ordinance on May 17, 2007. In the August <br />24, 2007 Objectives, Recommendations and Comments (ORC) Report, the Florida Department of Community <br />Affairs (DCA) provides five objections and four comments to the City of Sunny Isles Beach's proposed <br />Comprehensive Plan EAR-Based Amendments (DCA No. 07-1ER). The City's response and proposed <br />corrective actions are as follows. <br /> <br />Objection 1. Effect of Change to Future Land Use Category on Public Facilities and Hurricane <br />Evacuation Not Supported by Data and Analysis <br /> <br />DCA, the South Florida Water Management District (SFWMD), and Florida Department of Environmental <br />Protection (FDEP) objected to the City's proposed amendment to the Town Center interpretive text in Policy <br />15A. of the Future Land Use Element, as they felt that the City's proposed change would allow a greater density <br />and intensity than the Comprehensive Plan currently allows without an evaluation of impacts.
