9P -T3 <br />CITY OF SUNNY ISLES BEACH, FLORIDA <br />MEMORANDUM <br />TO: City Commission <br />FROM: Lynn M. Dannheisser� <br />City Attorney <br />DATE: May 11. 1998 <br />RE: Revised Lease to include space for Police Department <br />Please be advised, after several weeks of negotiations among R.K. Associates (the "Landlord "), <br />the Mayor, City Manager and myself, we have finally agreed on the terms of the lease reflected in <br />Exhibit "A" to this Resolution. <br />Basically, rent will commence on October 1, 1998. (The Landlord agreed to a rent concession <br />until that time.) The base rent for approximately 21,000 square feet shall be 510,500 per month. <br />There will be no operating expenses passed through during our occupancy. Beginning in January, <br />2004 if the City decides to renew its lease for two successive one year options, rent shall be <br />increased to $ 17,000 per month and subsequently in January, 2005 to $19,000. The private <br />elevator access costs S 1,000 per month for the duration of the lease. <br />There will be a separate, secure area for police vehicle parking which will require a variance so <br />Landlord's parking calculations are not adversely affected. The Landlord shall also assign a <br />specific space in front of our elevator for use to transport suspects and there will be three <br />additional spaces designated for police cars in the front area of the shopping center. <br />The Manager has also demanded our insurance requirements be lowered from five million to one <br />million dollars in liability. The Landlord shall also be responsible for the air conditioning units, <br />roof repairs, among other things, at its expense. <br />LMD:ch <br />cc: James DiPietro, City Manager <br />
