<br />/ <br />res~ictions, boundaries and contours of the building site; locations <br />dimensions and complete data pertaining to existing buil,dings, othe~ <br />improvements and trees; full information as to available service and <br />utility lines. both public and private; and test borings and pits <br />necessary for determining subsoil conditions. The Architect-Engineer's <br />setv'ices in obtaining this data by others shall be included in basic <br />setv'ices. <br /> <br />6.5 The Owner shall pay for structural, chemical, mechanical, soil mechanics <br />or other tests and reports, if required. <br /> <br />6.6 The Owner shall arrange and pay for such legal, auditing and insurance <br />counseling services as may be required by the Owner for the Project, <br /> <br />6.7 If the Owner observes or otherwise becomes aware of any defect in the <br />Project, he shall give prompt written notice thereof to the Architect- <br />Engineer and Contractor. <br /> <br />6.8 If the estimate of Construction Cost or Detailed Cost Estimates are in <br />excess of any limit stated herein, the Owner may give written approval of <br />an increase in the limit or he shall cooperate in revising the project <br />scope or quality, or both, to reduce the cost as required. <br /> <br />ARTICLE 7 <br /> <br />CONSTRUCTION COST <br /> <br />7.1 DEFINITION <br /> <br />(1) The Construction Cost shall be the total cost or estimated cost to <br />the Owner of all elements of the Project designed or specified by <br />the Architect-Engineer, The construction cost shall not exceed the <br />Owner's Construction Budget. The Owner's construction budget is <br />set forth in Article 1 and Exhibit B. <br /> <br />(2) The Construction Cost shall also include the cost of labor and <br />materials furnished by the Owner and any equipment which has been <br />designed, specified, selected or specially' provided for by the <br />Architect-Engineer. It shall also include the Contractor's <br />compensation for services, Reimbursable Costs and the cost of work <br />provided by the Contractor. <br /> <br />(3) <br /> <br />Construction Cost does not include the compensation of <br />ArChitect-Engineer and the Architect-Engineer' s consultants, <br />cost of the land, rights-of-way, or other costs which are <br />responsibility of the Owner. <br /> <br />the <br />the <br />the <br /> <br />(1) <br /> <br />7,2 RESPONSIBILITY FOR CONSTRUCTION COST <br /> <br />.} <br /> <br />The Architect-Engineer, as a design professional familiar with the <br />construction industry, shall assist the Contractor in evaluating <br />the Owner's proj ect budget and shall review the estimates of <br />Construction Cost prepared by the Contractor. It is recognized, <br />however, that neither the Architect-Engineer, nor the Owner has <br />control over the cost of labor, materials or equipment, over the <br />Contractors' method of determining Bid prices, or over competitive <br />bidding, market or negotiating conditions. Accordingly, the <br />Architect-Engineer cannot and does not warrant or represent that <br />Bids or negotiated prices will not vary from the Project budget <br />proposed, established or approved by the Owner, or from the <br />estimate of Construction Cost or other cost estimate or evaluation <br />prepared by the Contractor. <br /> <br />10 <br /> <br />llo. <br />
