<br />however, such direct costs associated with the Phase II and III Work exceed <br />the aforementioned contribution, Franchisee shall be responsible for the <br />difference in costs. <br /> <br />b. In all instances where FP&L opens the trenches for the purpose of <br />locating utility lines underground, and the City is not entitled to receive any <br />undergrounding contributions, either through voluntary proffer or by virtue <br />of the passage of Ordinance # 99-63, then the Franchisee shall bear the <br />costs of placing its cable TV facilities in the FP&L trench for Phase II and <br />III, excluding restoration and permitting costs. <br /> <br />c. In any instances where the City elects to underground cable television <br />wires in front of existing structures ,( i.e., converted motels), where FP &L <br />does not excavate the trench, and, Franchisee is requested to excavate such <br />trench, the City shall reimburse Franchisee for 100% of those direct costs <br />incurred within thirty (30) days of completion of the installation. <br /> <br />4. Time Frames. Franchisee shall coordinate the scheduling and timing of all <br />construction work with the City. Franchisee shall act diligently in locating its wires <br />and shall not cause any undue delay in the performance of the Work. <br /> <br />5. Permit Fees. The City hereby waives all City permit fees in conjunction with the <br />undergrounding work to be performed pursuant to this Paragraph 11. <br /> <br />C. Franchisee shall utilize, with the owner's permission, existing conduits, poles, or <br />other facilities whenever feasible. Copies of agreements for use of conduits or other facilities shall <br />be filed with the City, pursuant to Section 19(e) of Ordinance No, 99- '=fa . <br /> <br />D. All of franchisee's transmission lines, equipment, structures and other facilities <br />shall be installed, located and maintained so as to cause minimum interference with the rights and <br />convenience of property owners. The City may issue such rules and regulations concerning the <br />installation and maintenance of a cable system installed in, on, or over public streets, as may be <br />consistent with the ordinance. <br />E. All safety practices required by applicable federal, state or local law or accepted <br />industry practices and standards shall be used during construction, maintenance and repair of the <br />cable system. <br /> <br />F.
