<br />disconnection, and equipment rental to the full extent permitted by and consistent with State and <br />Federal law. <br /> <br />B. Franchisee further agrees that it shall not increase rates or charges for basic cable <br />service, installation, disconnection, or equipment rental without at least 30 days prior notice to <br />subscribers and the City. <br /> <br />C. Pursuant to Section 18 of Ordinance No. 99-b~ franchisee shall at all times charge <br />nondiscriminatory rates throughout the City. <br /> <br />D. Franchisee shall not engage in predatory pricing or any other anti-competitive <br />business practice as defined by applicable law. <br /> <br />Section 33. Security fund. <br /> <br />A. Pursuant to Section 10 of the ordinance, franchisee shall provide the City a security <br />r:fiJ. fund or in the alternative a bond or letter of credit, as approved by the City Manager, in the <br />$~I ~I^- *,amount of $5ctOOO.00 as security for the faithful performance of all provisions of the franchise <br />"P"""" agreement, Ordinance No. 99- ~f the City, and all applicable State and Federal law . If such <br />security fund or corporate guarantee is not furnished to the City within 60 days of the date of <br />Commission resolution approving the grant of the franchise, then franchisee shall pay to the City <br />Manager a fine in the amount of $500.00 per day, beginning on the 61st day, until the date on <br />which the security fund or corporate guarantee is received by the City. In the event said guarantee <br />is not received within 60 days of the date after the Commission resolution approving the grant of <br />the franchise, this franchise agreement and the grant of the franchise will become null and void <br />without further action by the City. <br /> <br />B. If 30 calendar days after written notice franchisee fails to pay to the City any fees <br />or taxes due and unpaid, or any liquidated damages, damages, costs or expenses that the City has <br />incurred by reason of any act, omission or default of franchisee in connection with this franchise <br />agreement or Ordinance No.99~ or amendments thereto, the City may immediately withdraw <br />that amount, with interest and any costs, from the security fund or make such equivalent claim <br />against the guarantee. Upon such withdrawal or claim, the City shall notify franchisee in writing <br />of the amount and date of the withdrawal. <br /> <br />C. Within 30 calendar days after notice to franchisee that an amount has been <br />withdrawn by the City from the security fund, franchisee shall restore the security fund to its <br />original amount.
