<br />RESOLUTION NO. 2000-28.-7 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, REQUESTING <br />THE BOARD OF COUNTY COMMISSIONERS TO AMEND <br />THE CONE OF SILENCE ORDINANCES TO EXEMPT <br />MUNICIPALITIES, OR, IN THE ALTERNATIVE TO <br />REMOVE THE CONE OF SILENCE ORDINANCE FROM <br />CHAPTER TWO OF THE MIAMI-DADE COUNTY CODE IN <br />ORDER THAT THE ORDINANCE WOULD NOT APPLY TO <br />MUNICIPALITIES WITHIN MIAMI-DADE COUNTY; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the Cone of Silence Ordinances passed by Miami-Dade County, which prohibit <br />communication regarding a particular RFP, RFQ, or bid between a potential vendor, service <br />provider, bidder, lobbyist, or consultant and City staff, including but not limited to the City Manager; <br />and <br /> <br />WHEREAS, although the concept behind the Cone of Silence is an excellent one, for smaller <br />municipalities such as the City of Sunny Isles Beach, such an ordinance thwarts staff s ability to <br />conduct business in any efficient and effective manner, particularly if and when, the only employee <br />of a particular department is also the Department Director; and <br /> <br />WHEREAS, it is particularly burdensome, impractical, and unrealistic to completely remove <br />verbal contact between contacting vendors or proposers and this city, athough the City endorses the <br />concept. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Request of City Commission. The City Commission of the City of Sunny Isles <br />Beach respectfully requests that the County Commission either exempt municipalities from the <br />application of the Cone of Silence Ordinances so they can tailor the ordinance to their own particular <br />needs, or <br /> <br />Section 2. Removal of Cone Silence Ordinances from Chapter Two. Alternatively, the City <br />Commission would respectfully request the Board of County Commissioners to direct the County <br />Clerks's office to remove the Cone of Silence Ordinances in the aggregate from Chapter Two of the <br />Miami-Dade County Code and to the contracting section ofthe code in order that the cities may be <br />exempted from application of the Cone of Silence Ordinances in order that the City may draft a <br />similar ordinance tailored to the needs of the particular city. <br /> <br />Cone Of Silence Exemption Request Reso <br />
