<br />RESOLUTION NO. 2000-300 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES <br />BEACH, FLORIDA, ~OPTING A POLICY THAT ALL ZONING APPLICATIONS FILED <br />BEFORE OCTOBER 15;' ~OOO, WOULD BE CONSIDERED UNDER MIAMI-DADE <br />COUNTY'S COMPREHE~SIVE PLAN WHICH GOVERNED DEVELOPMENT IN THE <br />CITY UNTIL THE ADOPTION OF THE CITY'S NEW COMPREHENSIVE PLAN ON <br />OCTOBER 15,2000; AUTHORIZING THE CITY ATTORNEY TO DEFEND THE CITY IN <br />CIRCUIT COURT WITH RESPECT TO ZONING RESOLUTION 00-Z-55; PROVIDING <br />FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, on September 14,2000 Beverly Towers, Inc filed an application for a property <br />located at 16875 Collins Avenue attached hereto as Exhibit "A"; and <br /> <br />WHEREAS, after due notice and full public hearing, the City Commission approved the <br />application in accordance Resolution 00-Z-55 attached hereto as Exhibit "B; <br /> <br />WHEREAS, by Ordinance No.2000-105, the City Commission adopted a new <br />Comprehensive Plan for the City of Sunny Isles Beach which became effective October 15, 200 and <br />was subsequently approved by the Department of Community Affairs; and <br /> <br />WHEREAS, on December 11, 2000, the City received an amended verified complaint <br />pursuant to 163.321 (4), Florida Statutes challenging the consistency of Resolution 00-Z-55 with the <br />contents of the newly adopted comprehensive plan; and <br /> <br />WHEREAS, in response to the verified complaint, the City Commission held an executive <br />session concerning the complaint and immediately thereafter, held a public hearing on December 14, <br />2000, at which they discussed issues raised by the complaint; <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Adoption of Policy with respect to applicability of Comprehensive Plan. The City <br />Commission hereby adopts the policy that all zoning applications filed before October 15, 2000, <br />would be considered under the terms and conditions of the Comprehensive Plan of Miami Dade <br />County, which governed development in the City until the adoption ofthe City's new Comprehensive <br />Plan on October 15,2000. <br /> <br />Section 2. Authorization of City Attorney. Should the plaintiffs file their verified complaint <br />with the circuit court pursuant to Section 163.3215, Florida Statutes, the City Attorney is hereby <br />authorized to defend the City in court with respect to zoning Resolution 00-Z-55. <br /> <br />Section 3. <br /> <br />Effective Date.
