<br />WHEREAS, on October 5, 2000, the Commission adopted the Sunny Isles Beach <br />Comprehensive Plan; and <br /> <br />WHEREAS, the findings of the Impact Fees Report relating to impact fee assumptions, <br />residential, non-residential and transient development projections; capital improvements and <br />the cost thereof; and impact fee calculations have been incorporated into the Impact Fees <br />Manual, which is contained in Exhibit "A" of this Resolution; and <br /> <br />WHEREAS, based on the population, housing units and land use projections as well as <br />the public facility needs associated with the projected level of growth, the Commission has <br />determined that impact fees continue to be an appropriate and necessary technique, to be used <br />in conjunction with other available public facility financing techniques, to ensure that adequate <br />public facilities are provided to new growth; and <br /> <br />WHEREAS, the Commission has determined that impact fees will continue to be <br />necessary for parks and recreation facilities and vehicles and police facilities and vehicles, and <br />is necessary to now impose impact fees for general municipal facilities and vehicles and the <br />existing interim impact fees for parks and recreation facilities and police services should be <br />repealed; and <br /> <br />WHEREAS, the Commission has found and determined, after extensive study by <br />consultants, that impact fees for different public purposes will have certain common <br />characteristics and that the City will, therefore, benefit from the adoption and use of a uniform <br />procedure for the imposition, calculation, collection, expenditure and administration of all of <br />the adopted impact fees; and <br /> <br />WHEREAS, the use of uniform procedures, to the extent possible, will be more <br />efficient and expedient for both the City and applicants for building permits than separate <br />procedures for each impact fee; and <br /> <br />WHEREAS, the use of uniform procedures will simplify the implementation and <br />administration of impact fees; and <br /> <br />WHEREAS, the use of uniform procedures will best ensure that impact fees are <br />"earmarked" and expended for the public purposes for which they were imposed and collected <br />and will be contained in the imposition ordinances; and <br /> <br />WHEREAS, all monies collected from impact fees shall be deposited in an interest- <br />bearing account which clearly identifies the category, account, fund and public facility or <br />improvement for which such fee was imposed; and <br /> <br />WHEREAS, each such category, fund or account shall be accounted for separately; <br />provided, however, that the determination as to whether the accounting requirement shall be by <br />category, account or fund and whether by aggregate or individual development shall be within <br />the discretion of the City; and <br /> <br />Impact Fees Resolution <br /> <br />2 <br />
