First Street, Suite 2910 <br />Miami, Florida 33128 -1994 <br />Re: Entrance Feature Sign <br />Dear Mr. Ginsburg: <br />REECEIV J <br />NO V 1 2002 <br />f� <br />City of Sunny Islas Beach <br />Via Facsimile and U.S. Mail <br />As you may know, the City of Sunny Isles Beach has requested permission from Miami - <br />Dade County to install an entrance feature sign near the Sunny Isles walk path at the <br />northern part of Haulover Beach. <br />Mayor David Samson has spoken to Mayor Alex Penelas and County Manager Steve <br />Shiver about the City's request. It is my understanding that Mayor Penelas and the <br />County Manager are in agreement with the City's request providing that your office has <br />no objection to the request. <br />We do not believe that your office will have any objection to the request because it <br />appears that the City's request is permissible under Article 6 of the County's Charter. A <br />plain reading of Article 6 suggests that Article 6 precludes "permanent structures" or <br />"commercial advertisement" signs. The entrance sign that the City plans to install is <br />neither a permanent structure not a I commercial sign. Therefore, Article 6 does not <br />apply in this case. <br />Even if we assume that Article 6 is applicable in the instant case, the City's entrance sign <br />would be permitted under the exceptions provided in Article 6. Arguably, the City sign <br />would fall under the exceptions for appropriate monument and work of art. <br />Without access to the legislative history of Article 6, it is very difficult for me to <br />determine the purpose of Article 6. However, a plain reading of the entire Article clearly <br />suggests that the purpose of Article 6 is to prevent the commercial exploitation of <br />public property. Here, we are merely trying to promote a public purpose by providing a <br />destination sign that will benefit the tourists in Miami -Dade County. <br />
