(305)949-3113 Fax <br /> MEMORANDUM <br /> TO: The Honorable Mayor and City Commission <br /> FROM: Hans Ottinot, City Attorney <br /> DATE: 5/19/2016 <br /> RE: Approving Condominium Documents for the Gateway <br /> Park Commercial Condominium Association, Inc. <br /> RECOMMENDATION: <br /> This Resolution is presented for your consideration. <br /> REASONS: <br /> The City intends to lease certain areas in the parking garage located at <br /> Gateway Park to private retail restaurant operators. Based on <br /> instructions provided by Miami-Dade County, the City is creating a <br /> commercial condominium within the Gateway Parking Garage to ensure <br /> that property taxes are imposed on the areas dedicated to private <br /> commercial uses. <br /> The City Commission will be designated as the Board of Directors for <br /> the condominium association called Gateway Park Commercial <br /> Condominium Association, Inc. ("Association"). The City Commission <br /> will have the authority to appoint the officers for the Association. The <br /> President will be the City Manager, whereas the City Clerk and the <br /> Finance Director shall serve as Secretary and Treasurer for the <br /> Association.
