<br />RESOLUTION NO. 2002- 50) <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, PROVIDING FOR THE VACATION <br />OF AN ALLEY RUNNING NORTH AND SOUTH FROM 185 STREET TO <br />191 STREET AS MORE FULL Y DESCRIBED IN EXHIBIT "A"; <br />PROVIDING FOR THE CITY MANAGER TO DO ALL THINGS <br />NECESSARY TO EFFECTUATE THIS RESOLUTION; AND <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, a twenty (20) foot alley was dedicated to Miami-Dade County for public <br />use, utility easement; and <br /> <br />WHEREAS, the City obtained jurisdiction over the alley pursuant to an Interlocal <br />Agreement dated November 4, 1997 by and between the City and Miami-Dade County; and <br /> <br />WHEREAS, pursuant to its home rule authority under Chapter 166, Florida Statutes <br />and the aforesaid Interlocal Agreement, the City has the authority to vacate, alter or discontinue <br />any public alley and right-of -way over which it has jurisdiction; and <br /> <br />WHEREAS, the City Commission has determined that the alley described in Exhibit <br />"A" herein presently not used by the citizens or the City As a public right-of-way and the City is <br />proposing to vacate the alley; and <br /> <br />WHEREAS, the abutting property owners have agreed to honor all utility easement that <br />burdens the ally prior to its abandonment by the City; and <br /> <br />WHEREAS, the City Commission has determined that the vacation of the alley will not <br />have an adverse impact on the citizens of the City of Sunny Isles Beach and the vacation is in the <br />best interest of the public; and <br /> <br />WHEREAS, the City has determined that the alley is not being used by abutting property <br />owners for ingress and egress to their property. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Recitals. The foregoing recitals are true and correct and are incorporated herein <br />by reference as if they fully set for the herein. <br /> <br />Section 2. Conditions Required For Vacation: That the City Commission of the city of <br />Sunny Isles Beach hereby agrees to vacate the aforementioned alley with the following <br />conditions: <br /> <br />(1) The property owners agree that the vacation of the alley shall not interfere or affect <br />any utility easement or private easement that burdens the alley; and <br /> <br />Resolution Providing for the Vacation of an Alley I <br />HO:jb A: Reso 1 <br />12/5102 -- 2:33 PM <br />
