<br />RESOLUTION NO. 2003- -52. \ <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, ESTABLISHING AN AMNESTY PERIOD <br />REFRAINING FROM THE ENFORCEMENT OF SECTION 901.5(9) OF THE <br />CITY LAND DEVELOPMENT REGULATIONS AS ADOPTED; <br />ESTABLISHING CERTAIN CONDITIONS OF THAT WAIVER; <br />PROVIDING FOR THE EFFECTIVE PERIOD OF THE AMNESTY FROM <br />FEBRUARY 1, 2003 THROUGH JULY 31, 2003; PROVIDING FOR <br />PENALTIES; AND PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City of Sunny Isles Beach is a major tourist destination in Florida; and <br /> <br />WHEREAS, tourist based businesses located in the city have suffered tremendous financial <br />hardships since the tragic events of September 11 th; and <br /> <br />WHEREAS, the City Commission wishes to assist local businesses in their effort to <br />stimulate the local economy with an opportunity to maximize advertisement opportunities; <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. <br /> <br />Amnesty. <br /> <br />Notwithstanding anything to the contrary, the City of Sunny Isles Beach hereby declares a special <br />period for the temporary waiver of enforcement of Section 901.5(9) of the City of Sunny Isles Beach <br />Land Development Regulations for all businesses within the City. Specifically, the City will permit <br />temporary banner signs for a period not to exceed six-months to be known as the "Amnesty Period", <br />subject to review and approval as set forth in Section 2. All other sections of the City Code of <br />Ordinances as adopted shall remain in full force and effect. <br /> <br />Section 2, <br /> <br />Conditions. <br /> <br />No banner signs shall be placed on any structure without the prior review and written approval ofthe <br />Zoning Director of the Planning, Zoning, and Building Department. The City reserves the right to <br />reject banner signs that may impose a threat to the general, health safety or welfare of our residents <br />and visitors or that is inconsistent with the Comprehensive Plan or other general regulations ofthe <br />Land Development Regulations. <br /> <br />Section 3. <br /> <br />Penalties for Violation. <br /> <br />Notwithstanding the provisions ofthis Resolution, the Zoning Director, Building Official, and Code <br />Enforcement and Licensing Department Director may at all times continue enforcement of the <br />applicable Codes through any authorized means including issuance of a Waming Notice of Violation <br />and/or the issuance of a Civil Notice of Violation and associated penalties.
