<br />AMENDMENT NO.2 <br />TO LANDSCAPING CONTRACT BY AND BETWEEN <br />CITY OF SUNNY ISLES BEA.CH AND VILA & SON LANDSCAPING CORP. <br />DATED MAY 29, 2002 <br />FOR ADDITIONAL LANDSCAPING & IRRIGATION <br />! <br />OF COLLINS AVENUE (SJ1. A-I-A) <br /> <br />WHEREAS, the Vila & Son Landscaping Corp. was hired by the City to perform landscaping <br />and improvements under the referenced contract for landscaping and irrigation of Collins <br />Avenue and other sites within the City as approved by Resolution No. 2002-442; and <br /> <br />WHEREAS, pursuant to Paragraph 2 - Additional Services, of the referenced contract, the City <br />requests additional landscaping and irrigation work to be performed on Collins Avenue due to <br />the recent widening of the median by FDOT, for which additional work the City has received a <br />Statement of Probable Construction Cost, dated April 1, 2003, from O'Leary Design Associates, <br />P.A., in the amount of$31,650.00; and <br /> <br />WHEREAS, the City, being satisfied with the performance and quality of workmanship of Vila <br />& Son, wishes to contract with Vila & Son Landscaping Corp., to perform this additional work <br />via this Amendment No.2 to Vila's landscaping contract referenced above; <br /> <br />NOW THEREFORE, in accordance with the O'Leary Design Associates, P.A.'s Statement of <br />Probable Construction Cost, dated April 1, 2003, and attached hereto as Exhibit "A," in the <br />amount of $31,650.00, the City hereby amends Vila & Son Landscaping contract as follows: <br /> <br />1. Additional landscaping and irrigation service to be performed on Collins Avenue at <br />an additional cost of $31,650.00, as more particularly described in the attached <br />Exhibit "A." Payments to be made monthly as invoiced. <br /> <br />2. The original contract amount is hereby increased by Thirty-One Thousand Six <br />Hundred Fifty and No/I00 Dollars ($31,650.00) to One Million One Hundred <br />Five Thousand Forty-Two and 40/100 ($1,105,042.40). <br /> <br />3.
