<br />RESOLUTION NO. 2003-~ <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, APPROVING THE RELEASE OF <br />TWO DECLARATION OF RESTRICTIONS FOR THE DUNES HOTEL, <br />ATTACHED HERETO AS EXHIBIT "A"; PROVIDING THE CITY <br />MANAGER WITH THE AUTHORITY TO DO ALL THINGS <br />NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING <br />FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, a request has been made for the release of two declaration of restrictions <br />imposed upon the Dunes Hotel situated at 17001 Collins Avenue; and <br /> <br />WHEREAS, the declaration of restrictions were recorded in the official records of <br />Miami-Dade as part of a prior zoning approval issued by Miami-Dade; and <br /> <br />WHEREAS, staffhas reviewed the request and has no objection to the request. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION <br />OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Release of Agreements. The City Commission hereby releases the declaration of <br />restrictions imposed upon the Dunes Hotel, which are recorded in the Official Records Book <br />4196 at Page 438 and Book 6443 at Page 455, provided the Dunes Hotel is no longer in <br />operation, <br /> <br />Section 2. Authority of City Manager .The City Commission hereby gives-the City Manager <br />the authority to do all things necessary to effectuate this Resolution, <br /> <br />Section 3. <br /> <br />Effective Date.
