<br />-II = <br /> <br />Emplovment Aareement between City of Sunny Isles Beach and Lvnn M. Dannheisser <br /> <br />This agreement is made and entered into this (~~ day of June, 2003, between the City of <br />Sunny Isles Beach, Florida (herein after the "City") and Lynn M. Dannheisser (hereinafter the <br />"Employee"), pursuant to the following terms and conditions ("Agreement"): <br /> <br />A. Whereas, the City wishes to continue the employment of the services of Lynn M. <br />Dannheisser as the City Attorney of the City of Sunny Isles Beach; and <br /> <br />B. Whereas, Employee wishes to accept continued employment as City Attorney of said <br />City under terms and conditions, set forth herein. <br /> <br />Now, therefore, in consideration of the mutual promises and covenants contained herein <br />the City and Employee agree to the following: <br /> <br />SECTION 1. DUTIES' <br /> <br />A. The City agrees to continue the employment of Lynn M. Dannheisser as the City <br />Attorney of the City of Sunny Isles Beach to perform the duties and exercise powers <br />as prescribed by the City Charter, and to perform such other legally permissible and <br />proper duties and functions as assigned by the City Commission from time to time. <br /> <br />B. The City Attorney shall perform the duties of City Attorney of the City in accordance <br />with the terms, conditions and provisions contained in this Agreement and the <br />Charter in a professional and respectable fashion and with full decorum required of <br />City Attorneys generally and as required by the Rules Regulating The Florida Bar <br />and the Guidelines for Professional Conduct. The Employee recognizes that the <br />position of City Attorney is not, and cannot be, a nine- to- five employment position <br />and, while it is agreed and understood that the City Attorney shall attempt to perform <br />all work on three (3) designated days per week, preferably Monday, Tuesday and <br />Thursday, as .consideration of her continued employment, she nevertheless agrees <br />to devote the time and energy, which is reasonably necessary to perform the duties <br />required under this Agreement, carry out her responsibilities regardless of <br />designated days, and she shall use her best efforts to be available whenever a legal <br />emergency arises. <br /> <br />SECTION 2. TERM OF AGREEMENT <br /> <br />A. The term of this agreement shall be effective immediately (except where specifically <br />indicated otherwise) and shall continue until terminated, or otherwise amended from <br />time-to-time, by the City Commission. The City Attorney shall serve at the pleasure <br />of the City Commission. <br /> <br />B. Nothing in this agreement shall prevent, limit or otherwise interfere with the right of <br />the City Commission to terminate the services of Employee at any time, subject only <br />to the provisions set forth in SECTION 11 of this Agreement. <br /> <br />C. Nothing in this agreement shall prevent, limit or otherwise interfere with the right of <br />the Employee to resign at any time from the position of City Attorney, subject only to <br />the provisions set forth in SECTION 11 of this Agreement. <br /> <br />A:/City Attorney's Employment Agreement <br />LMD:ch 6/16/03 --11:38 AM <br />
