<br />RESOLUTION NO. 2003- ~'61 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, PRELIMINARILY <br />APPROVING THE LEASE AGREEMENT BETWEEN THE CITY <br />OF SUNNY ISLES BEACH AND ROMACORP; AUTHORIZING <br />THE CITY ATTORNEY AND THE CITY MANAGER TO <br />NEGOTIATE THE TERMS OF THE ATTACHED LEASE BY <br />AND BETWEEN THE CITY OF SUNNY ISLES BEACH AND <br />ROMACORP, TO BE APPROVED IN ITS FINAL FORM AT THE <br />NEXT PUBLIC HEARING OF THE CITY COMMISSION; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City has purchased the property located at 18050 Collins Avenue for the <br />purposes of building a government center and re-building the Roma restaurant; and <br /> <br />WHEREAS, the City's staff has been negotiating with RomaCorp., on the terms of the <br />lease by and between the City of Sunny Isles Beach and RomaCorp., Inc.; and <br /> <br />WHEREAS, only this week a final lease has been delivered to the City for its review and <br />upon initial review, it appears as though the items requested by the City to be included in the <br />lease have been so included, but there may be other items that need to be negotiated; and <br /> <br />WHEREAS, there is no meeting until the end of August or beginning of September, the <br />City Manager and City Attorney are requesting preliminary approval as to the attached least <br />between the City of Sunny Isles Beach and RomaCorp., Inc., and the authority to negotiate a <br />final lease to be brought back before the City Commission for final approval; <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH AS FOLLOWS: <br /> <br />Section 1. Approval of Lease. The City Commission hereby preliminary approves the lease <br />between the City of Sunny Isles Beach and RomaCorp., Inc., attached hereto as Exhibit "A." <br /> <br />Section 2. Authority of City Manager and City Attorney. The City Commission hereby <br />grants the City Manager and City Attorney the authority to negotiate the final lease which shall <br />be ratified at the next City Commission meeting. <br /> <br />Section 3. <br /> <br />Effective Date.
