<br />RESOLUTION NO. 2003- 522- <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, APPROVING THE RELEASE OF AN <br />AGREEMENT AND A BEACH ACCESS EASEMENT AGREEMENT FOR <br />D.P. COLONIAL, LLC, ATTACHED HERETO AS EXHIBIT "A"; <br />PROVIDING THE MAYOR TO EXECUTE THE RELEASE AND <br />AUTHORIZING THE CITY MANAGER TO DO ALL THINGS <br />NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING <br />FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, a request has been made for the release of an Agreement imposed upon the <br />property situated at 18101-18145 Collins Avenue, a/k/a Colonial Hotel; and <br /> <br />WHEREAS, the Agreement was recorded in Official Record Book 18398 Page 3768- <br />3777 in the official records of Miami-Dade as part of a prior zoning approval issued under <br />Resolution 98-Z-9 and 98-Z-24; and <br /> <br />WHEREAS, staff has reviewed the request and has no objection to the request. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION <br />OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Release of Declaration. The City Commission hereby releases the Agreement <br />imposed upon the property, which was recorded in the Official Records Book 18398 at Page <br />3768-3777, provided the Colonial Hotel is no longer in operation. <br /> <br />Section 2. Authority of Mayor. The City Commission hereby gives the Mayor the authority <br />to execute the release of the Agreement and authorizing the City Manager to do all things <br />necessary to effectuate this Resolution. <br /> <br />Section 3. <br /> <br />Effective Date.
