<br />RESOLUTION NO. 2005- 83" <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CITY <br />MANAGER TO PAY THE REASONABLE ATTORNEY'S FEES, <br />APPRAISER'S FEE AND COURT COSTS IN THE AMOUNT OF <br />ONE HUNDRED AND NINETEEN THOUSAND FIVE HUNDRED <br />AND TEN DOLLARS, 74/100 ( $119,510.74) TO THE LAW FIRM <br />OF KRONENGOLD & DANZ AS EVIDENCED IN EXHIBIT "A" & <br />"B" FOR COSTS INCURRED IN THE EMINENT DOMAIN CASE, <br />CITY OF SUNNY ISLES BEACH V. 18100 COLLINS AVENUE. <br />SHOPPING CENTER. LTD., PROVIDING FOR THE CITY <br />MANAGER TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, on May 22, 200:;, the City made a determination that it needed to acquire <br />additional property to construct a public works facility; and <br /> <br />WHEREAS, the City of Sunny Isles Beach initiated an eminent domain action against <br />18100 Collins Avenue Shopping Center, Ltd, et al. to condemn the property located at 18080 <br />Collins avenue (" Vanguard Property"); and <br /> <br />WHEREAS, on April 4, 2005 the City obtained title to Property leased by Vanguard Car <br />Rental USA, Inc. ("Vanguard"); and <br /> <br />WHEREAS, on April, 14,2005, the City Commission authorized the Mayor to execute <br />the First Addendum to Lease Agreement between the City and Vanguard Car Rental USA Inc.; <br />and <br /> <br />WHEREAS, pursuant to the amended lease, the City is required to pay Vanguard <br />attorney's fees and costs and court costs; and <br /> <br />WHEREAS, Vanguard's attorney has submitted reasonable attorneys' fees, court costs <br />and appraisal fees for the Vanguard Property as follows: <br /> <br />a. <br />b. <br /> <br />Kronengold & Danz <br />Gallion Wilson, LLC, Inc.(Appraiser) <br />Kronengold & Danz (Court Costs) <br /> <br />$91,801.00 <br />$ 23,637.50 <br />$ 4,072.24 <br /> <br />c. <br /> <br />attached hereto as Exhibit "A' & "B"; <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Approval of the Payments. The City Commission hereby approves the payment of <br />attorney's fees, appraisal fees and court costs in the amount of One Hundred and Nineteen <br />Thousand Five Hundred and Ten Dollars, 74/100 ($119,510.74) submitted by Vanguard's <br />
