Milton & Associates (the <br />"Buyer"). The Buyer owns all property abutting our client's property and is in the process of <br />developing the St. Tropez Project. Under the terms of our Contract, the transaction was required <br />to close on or before September 13, 2006, but the seller is required to satisfy certain conditions <br />prior to the closing, including the termination of an old drainage casement created in favor of <br />Miami-Dade Countv. Florida in 1966. <br /> <br />The parties have agreed to extend the closing date to September 22, 2006, which is why <br />the termination of this easement is urgent. Keep in mind that we confirmed with the County that <br />it has not done anything with this easement for years and of course it no longer handles drainage <br />within the city limits of Sunny Isles Beach. Accordingly, the City has succeeded to the interest <br />of the County as it relates to this easement but in fact it has been dormant for many years and as <br />you know the property has been unoccupied for quite some time. The good news is that this will <br />change soon if the property can be conveyed to the Buyer as contemplated by the Contract, who <br /> <br />{FT341932;1} <br />
