<br />RESOLUTION NO. 2006-.9..J 7 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, URGING THE STATE LEGISLATURE TO <br />CHANGE STATE LAW SO AS TO PRECLUDE CELLULAR TELEPHONE <br />USAGE BY MOTOR VEHICLE DRIVERS WHILE LOCATED IN A <br />SCHOOL ZONE; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission of the City of Sunny Isles Beach is deeply saddened <br />by recent new reports of the death of a minor child that was crossing the street within a school <br />zone due to a driver's negligence and cellular phone usage while operating a motor vehicle; and <br /> <br />WHEREAS, the City Commission are concerned with the health, safety, and welfare of <br />minors crossing the street in school crossing areas; and <br /> <br />WHEREAS, it would promote the health, safety and welfare of all residents, and in <br />particular would protect the youth of the state if the state were to preclude the use of cellular <br />telephones by persons operating motor vehicles while located in a school zone; and <br /> <br />WHEREAS, the City Commission urges the State Legislature to amend or modifY state <br />law so as to preclude the use of cellular telephones by persons operating a motor vehicle while <br />located within a school zone. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. <br />reference. <br /> <br />Incomoration of Recitals. <br /> <br />The above whereas clauses are incorporated by <br /> <br />Section 2. Request of the City Commission. The City Commission of the City of Sunny Isles <br />Beach hereby requests that the State Legislature modifY or amend existing laws so as to prohibit <br />the use of cellular telephones by persons operating motor vehicles while located in a school zone. <br /> <br />Section 3. Direction to City Clerk. The City Clerk is hereby directed to transmit a certified <br />copy of this Resolution to the City's State Representatives and to the State Legislature, and an <br />executed copy to the Mayor of Miami-Dade County, each member of the Miami-Dade Board of <br />County Commissioners, as well as each municipal clerk in Miami-Dade County for the purpose <br />of distributing copies to members of their respective governing councils in order to seek support <br />for the proposed change in State law. <br /> <br />Section 4. <br /> <br />Effective Date.
