<br />t <br /> <br />/ <br /> <br /> <br />DECLARATION OF A LOCAL EMERGENCY <br />CITY OF SUNNY ISLES BEACH, FLORIDA <br /> <br />WHEREAS, pursuant to Chapter 29 of the City of Sunny Isles Beach Code, the City <br /> <br />Manager hereby finds and declares the following: <br /> <br />I. Due to Hurricane Ernesto, the City of Sunny Isles Beach is facing dangerous <br /> <br />conditions of sufficient severity and magnitude to warrant coordinated local government action <br /> <br />to prevent or alleviate the damage, loss, hardship or suffering threatened or caused thereby; <br /> <br />2. Due to Hurricane Ernesto, a condition of extreme peril of life and property <br /> <br />necessitates the proclamation of the existence of an emergency, and the exercise of emergency <br /> <br />response plans consistent with state and county emergency plans for the mitigation of, <br /> <br />preparation for, response to, and recovery from emergencies, and to exercise all powers <br /> <br />permitted by Chapter 252, Florida Statutes. <br /> <br />3. The following emergency measures are hereby promulgated, with the specified <br />limitations and conditions; <br /> <br />(a) Orders of evacuations shall be consistent with that issued by Miami-Dade <br /> <br />County; <br /> <br />(b) The City shall adhere to the general curfew guidelines adopted by Miami- <br /> <br />Dade County. <br /> <br />(c) Price-gouging or the sale of merchandise, goods or services including, but <br /> <br />not limited to fuel, ice, or other essentials at more than the average retail <br /> <br />prices is hereby prohibited; <br /> <br />4. The emergency plans applicable to the City pursuant to Section 870.044, Florida <br /> <br />Statutes, as it relates to overt acts of violence or the imminent threat of such violence, are hereby <br /> <br />enacted, <br /> <br />Exhibit" A" <br />
