Hines, City Clerk <br /> <br />MEMORANDUM <br /> <br />The Honorable City commiSSiOJ)~. . \ / <br /> <br />Hans Ottinot, City Attorney v10 \J <br /> <br />January 18, 2007 <br /> <br />Fire Station Lease Agreement <br /> <br />RECOMMENDATION: <br /> <br />The attached Lease Agreement with Miami-Dade County to construct a Sunny Isles Beach Fire <br />Station is presented for consideration and approval and it is proposed that the existing Fire <br />Station Lease Agreement be rescinded in its entirety. <br /> <br />REASONS: <br /> <br />On or about July 20, 2006, the City Commission adopted a Fire Station Lease Agreement with <br />construction improvements by Miami-Dade County. Following this approval, the County staff <br />requested additional changes to comply with Section 125.031, Florida Statutes, which prohibits <br />counties from entering into a lease term that exceeds thirty (30) years at anyone time. <br />Consequently, the Lease Agreement will be rescinded in its entirety and a new Agreement is <br />being proposed to reflect three consecutive terms of thirty years followed by a nine year term for <br />a total lease period of Ninety-nine (99) years.
