Hines, City Clerk <br /> <br />MEMORANDUM <br /> <br />TO: <br /> <br />The Honorable City commissio~. .~ C)" <br /> <br />Hans Ottinot, City Attorney IJ ~ ....., <br />February 15,2007 <br /> <br />FROM: <br /> <br />DATE: <br /> <br />RE: <br /> <br />Resolution Approvinga City-wide ADA Grievance Procedure <br /> <br />RECOMMENDATION: <br /> <br />This Resolution is presented for your consideration and approval. <br /> <br />REASONS: <br /> <br />The City is required to comply with Title II of the Americans with Disabilities Act (ADA) rules and <br />regulations which prohibit a public entity from discriminating against, excluding from participation <br />or denying public sponsored benefits, programs or services, to an otherwise qualified disabled <br />individual, solely by reason of such disability. <br /> <br />The ADA is a strict liability regulation and includes an attorney's fees provision, thus exposing the <br />City to liability. Additionally, it should be noted that the City, as an employer and landlord, is also <br />directly and indirectly affected by the provisions of Titles I (Employment) and III (Public <br />Accommodations and Commercial Facilities) of the ADA. <br /> <br />In order to achieve preliminary compliance with the ADA, the City must provide a method for the <br />public to address its concerns and conduct a self evaluation plan to evaluate its current services, <br />policies and practices.
