<br />Attachment A <br /> <br />Scope of Services <br /> <br />Contractor shall: <br /> <br />1. Sell, furnish, deliver, exhibit large aerial fireworks display for the City on <br />Saturday, June 16,2007, ("Display Date") for its tenth anniversary celebration in <br />a manner further provided on pages 2 and 3 to this exhibit, <br />2. In the event that the Display Date is postponed, then Contractor shall sell, furnish, <br />deliver, exhibit and display a large aerial fireworks display to be exhibited on <br />June 23, 2007 ("Postponement Date"), <br />3, Contractor shall provide sufficient trained personnel. <br />4, Obtain a barge for display of fireworks in the coastal waters of the City of Sunny <br />Isles Beach adjacent to Samson Park. <br /> <br />City shall: <br /> <br />I. Furnish the neccssary Policc and fire protection for the display arca. <br />2, Cooperatc with Contractor to securc all Police, Local, and State Permits, however, <br />Contractor shall solely bc rcsponsiblc for filing all necessary pcrmit applications. <br />3. Prior to, during and immediatcly following the display, bc solely responsible for <br />crowd control and dirccting all persons, exccpt for Contractors' employees, out of <br />thc designated dangcr areas and bchind safety zonc lincs, <br /> <br />The Parties mutually agree: <br /> <br />], Contractor rcservcs the right to make minor modifications and substitutions <br />providcd that such changes arc necessary and acceptable to thc City, and do not <br />advcrscly affect pricc, time of dclivcry, functional charactcr or display <br />pcrformance. <br />2. If thc location of the firing site, spectator's location, parking areas or structurcs is <br />decmcd unsuitable or unsafc in thc discretion of Contractor or its agcnts or <br />pcrsonnel, Contractor may redircct thc firing site to a morc suitable site, but no <br />further than 200 yards away from thc shoreline of the beach area, adjacent to <br />Samson Park, <br /> <br />Additional Services <br /> <br />If thc need for additional work or changes undcr this Agrcement is idcntified by <br />Contractor during thc coursc of performing its obligations hereundcr, Contractor shall sct <br />forth such additional work and thc cost thercof in a supplcmental work ordcr (a <br />"Supplcmcntal Work Ordcr") and submit such Supplemental Work Ordcr for approval by <br />the City no later than Junc 11, 2007.
