<br /> <br />CITY OF SUNNY ISLES BEACH <br />SUPERIOR PARK SYSTEMS, INC. AGREEMENT <br />CONTRACT NO. C0607-112 <br /> <br />THIS AGREEMENT ("Agreement") entered into this day of September 2007, by and <br />between the CITY OF SUNNY ISLES BEACH (hereinafter referred as to "City"), a municipal <br />corporation of the State of Florida, and SUPERIOR PARK SYSTEMS, INC., a Florida corporation <br />authorized to do business in the State of Florida (hereinafter referred to as "Contractor"). <br /> <br />RECIT ALS <br /> <br />WHEREAS, the City of Sunny Isles Beach is in need of a contractor to provide Artificial Grass, <br />Playground Unit and Shade Structure for the City's Samson Oceanfront Park ("Services"); and <br /> <br />WHEREAS, Contractor is a certified and insured company with the necessary experience to <br />provide the desired Services; and <br /> <br />WHEREAS, the City of Jacksonville, Florida issued Request for Proposal Bid No.SC-0511-06 <br />and awarded a contract to Contractor to provide such services; and <br /> <br />WHEREAS, the City desires to enter into an agreement with Contractor, using the City of <br />Jacksonville's bid information, to provide the Services described in Attachment "A", attached hereto and <br />made a part hereof, subject to the telms and conditions contained herein; and <br /> <br />WHEREAS, pursuant to the City's procurement code provisions, purchases made under state, <br />county or other governmental contracts, or competitive bids with other governmental agencies are exempt <br />from the City's competitive bidding procedures. <br /> <br />WHEREAS, the City wishes to contract with Contractor to provide the desired Services as more <br />particularly described in Attachment "B" for a total amount not to exceed One Hundred Seventeen <br />Thousand and Ninety-Eight Dollars and Seven Cents ($117,098.07); and <br /> <br />NOW THEREFORE, in consideration of the premises and the mutual covenants herein names, <br />the parties agree as follows: <br /> <br />TERMS <br /> <br />1. RECITALS: The recitals set forth above are hereby incorporated into this Agreement and made <br />a part hereof. <br /> <br />2. SERVICES: Contractor agrees to furnish all labor and materials in a good and workmanlike and <br />professional manner and to perform the Services designated in Attachment "A" and Attachment "B" <br />attached hereto, which is incorporated herein by reference.
