<br /> <br />o ~ ~ 0..I1'l <br /> <br />CITY OF SUNNY ISLES BEACH <br />GENERAL SERVICE AGREEMENT <br />WITH B & G FENCES, CORP. <br />CONTRACT NO: C0708-071 <br /> <br />THIS CONTRACTUAL AGRE-EMENT (hereinafter referred to as the "Agreement") <br />is made in duplicate, this JC\-H1day of Uun.~ ,2008, by and between the CITY <br />OF SUNNY ISLES BEACH, Florida, (hereinafter referred to as "City"), and B & G FENCES, <br />CORP. (hereinafter referred to as "Contractor") whose Federal I.D.# is <br />() "=J~ 5 00 ~t/e. . <br /> <br />RECIT ALS <br /> <br />WHEREAS, the City is in need of a contractor to provide furnishing and the installation <br />of black metal picket fence three feet (3') high on the medians along Collins Avenue in the City <br />of Sunny Isles Beach ("Services"); and <br /> <br />WHEREAS, Contractor has expressed the ability and desire to provide these Services <br />subject to the terms and conditions contained in its proposal as more fully described in <br />Attachment "A", which is attached hereto and made a part hereof; and <br /> <br />WHEREAS, the City desires to enter into this Agreement with Contractor to provide <br />the Services in a total amount not to exceed Ninety Thousand Four Hundred Dollars <br />($90,400.00); and <br /> <br />WHEREAS, due to the health, welfare and safety of residents and visitors alike, the City <br />Manager has recommended waiving the City's competitive bidding requirements for this project. <br /> <br />NOW THEREFORE, in consideration of the premises and the mutual covenants herein <br />names, the parties agree as follows: <br /> <br />1. RECITALS. The Recitals set forth above are hereby incorporated into this Agreement <br />and made a part hereof for reference. <br /> <br />2. SERVICES. Contractor shall provide to the City the Services more fully described in <br />the attached Attachment "A". The project will consist of three phases. Phase One is to remove <br />the existing planting and irrigation in the medians. Phase Two is the fence installation. Phase <br />Three involves the new plantings and irrigation. <br /> <br />3. MAINTENANCE. Contractor agrees to diligently maintain and care for the median <br />fencing in accordance with generally accepted industry standards, until the completion of the <br />term of this Agreement. <br /> <br />C0708-071 B & G FENCES.
