<br />FIRST AMENDMENT TO CITY OF SUNNY ISLES BEACH
<br />AND SOUTHEASTERN ENGINEERING CONTRACTORS INC.
<br />AGREEMENT CONTRACT NO. C0708-080
<br />
<br />THIS FIRST AMENDMENT is made and entered into this _day of 2008, by
<br />and between the CITY OF SUNNY ISLES BEACH, FLORIDA, a municipal corporation of the State of
<br />Florida, (hereinafter referred to as "City") and SOUTHEASTERN ENGINEERING CONTRACTORS
<br />INC., ("Contractor") a business corporation licensed in the State of Florida, whose Federal Identification
<br /># is
<br />
<br />WHEREAS, the City continuously experienced problems with flooding in the Central Island area,
<br />and was in need of engineering services for drainage improvements in the Central Island area; and
<br />
<br />WHEREAS, on December 18, 2003 the City Commission, via Resolution No. 2003-628,
<br />approved an agreement with Beiswenger, Hoch & Associates for Stormwater System Design, Technical
<br />Assistance and Bidding Process for Central Island Storm water Drainage; and
<br />
<br />WHEREAS, the City issued and advertised Bid No. 07-10-02, for a contractor to furnish all
<br />materials, equipment and labor for the Central Island Drainage and Street Improvements Project, and
<br />determined that the bid response from Contractor was the lowest most responsive responsible bid; and
<br />
<br />WHEREAS, on February 21, 2008 the City Commission, via Resolution No. 2008-1221, awarded
<br />Bid No. 07-10-02 to, and entered into an agreement with, Contractor to provide services on a unit price
<br />basis for the Central Island Drainage and Street Improvements Project, in an amount not to exceed Three
<br />Million Six Hundred Thirty-Five Thousand Eight Hundred Fifty-Two Dollars and Two Cents
<br />($3,635,852.02); and
<br />
<br />WHEREAS, the City now wishes to expand the scope of the original project to include curb and
<br />guttered streets with increased parking, street lighting, landscaping, and additional improvements to Gwen
<br />Margolis Park; and
<br />
<br />WHEREAS, Contractor has expressed the ability and desire to provide these services; and
<br />
<br />WHEREAS, Contractor has agreed to provide these additional services for the Central Island
<br />Drainage and Street Improvements Project, in an amount not to exceed Four Million One Hundred Two
<br />Thousand Five Hundred Fifty-Four Dollars and Ninety-Three Cents ($4,102,554.93), as more fully
<br />described in Attachment "A".

<br />NOW THEREFORE, in consideration of the foregoing and for the mutual covenants,
<br />representations and warranties and other good and valuable consideration, the receipt and adequacy of
<br />which is hereby acknowledged, the parties agree as follows:
<br />
<br />1. ADDITIONAL SCOPE OF WORK: Contractor shall provide additional services to include
<br />curb and guttered streets with increased parking, street lighting, landscaping, and additional
<br />improvements to Gwen Margolis Park, as more fully described in Attachment "A".
<br />
<br />2. COST: The total cost for this First Amendment shall not exceed Four Million One Hundred Two
<br />Thousand Five Hundred Fifty-Four Dollars and Ninety-Three Cents ($4,102,554.93) for said services.
