<br />RESOLUTION NO. 2009- I 3<6<../ <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, APPROVING A PAYMENT <br />TO THE MIAMI-DADE COUNTY PUBLIC SCHOOLS, IN THE <br />AMOUNT NOT TO EXCEED SEVEN HUNDRED FIFTY -FOUR <br />THOUSAND SEVEN HUNDRED FORTY -THREE DOLLARS <br />($754,743.00), FOR WORK COMPLETED AT THE SUNNY ISLES <br />BEACH COMMUNITY SCHOOL, INCLUDING DRAINAGE AND <br />PAVEMENT AROUND THE COMMUNITY SCHOOL, <br />MAINTENANCE OF TRAFFIC AROUND THE ATLANTIC <br />BOULEVARD AREA, AND THE PERIMETER RIGHT-OF-WAY <br />AROUND THE COMMUNITY SCHOOL, A TT ACHED AS <br />EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO DO <br />ALL THINGS NECESSARY TO EFFECTUATE THIS <br />RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, in 2003 the School Board and the City entered into an Interlocal Agreement <br />to ensure that plans for residential development are coordinated with the construction of new <br />schools; and <br /> <br />WHEREAS, on December 13, 2007, via Resolution No. 2007-1192, the City <br />Commission approved entering into an Amended and Restated Interlocal Agreement with the <br />School Board to adopt the necessary comprehensive plan amendments to establish public school <br />concurrency as a myriad of procedural actions required to successfully construct the desired <br />public school; and <br /> <br />WHEREAS, on March 20, 2008, via Resolution No. 2008-1247, the City Commission <br />approved entering into a Interlocal Agreement (which later became a "Letter of Agreement"), <br />with the County for a scope of work for the Sunny Isles Beach Community School including <br />drainage and pavement around the Community School, maintenance of traffic (MOT) around the <br />Atlantic Boulevard area, and the perimeter right-of-way around the Community School; and <br /> <br />WHEREAS, the City now wishes to submit a payment to the Miami-Dade County Public <br />Schools for completion of these services, in an amount not to exceed Seven Hundred Fifty-Four <br />Thousand Seven Hundred Forty-Three Dollars ($754,743.00). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Approval of Payment. The payment, in the amount not to exceed Seven Hundred <br />Fifty-Four Thousand Seven Hundred Forty-Three Dollars ($754,743.00), to Miami-Dade County <br />Public Schools, for completion of work around the Sunny Isles Beach Community School <br />including drainage and pavement around the Community School, maintenance of traffic (MOT) <br /> <br />R2009- Miami-Dade Co Public Schools Payment ofSrvs Page I of2 <br />
