<br />1 <br /> <br />RESOLUTION NO. 2009- l'i l b <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, APPROVING A JOINT PROJECT AGREEMENT <br />FROM THE FLORIDA DEPARTMENT OF TRANSPORT A TION (FDOT), <br />ATTACHED HERETO AS EXHIBIT "A", FOR THE CONTINUING TURF <br />AND LANDSCAPE MAINTENANCE OF SR-AIA (COLLINS AVENUE) AND <br />SR-826 (SUNNY ISLES BOULEVARD); AUTHORIZIING THE MAYOR TO <br />EXECUTE SAID AGREEMENT; AUTHORIZING THE CITY MANAGER TO <br />DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THE <br />AGREEMENT; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, as part of the continual updating of the State of Florida Highway System, <br />Florida Department of Transportation (FDOT), for the purpose of safety, has created roadside <br />areas and median strips on Collins Avenue from 156th Street to 196th Street and Sunny Isles <br />Causeway from the east side of Sunny Isles Boulevard to Collins Avenue; and <br /> <br />WHEREAS, the City of Sunny Isles Beach renews annually the Florida Department of <br />Transportation Joint Project Agreement for Turf and Landscape Maintenance for maintenance <br />and landscaping of median strips and roadside areas of SR-AIA (Collins Avenue - from 156th <br />Street to 196th Street) and SR-826 (Sunny Isles Boulevard - east side of Sunny Isles Bridge to <br />Collins Avenue); and <br /> <br />WHEREAS, said FDOT Maintenance Agreement shall commence on July 1, 2009, and <br />end on June 30, 2010, and has a renewal option which provides for a renewal if mutually agreed <br />to by both parties, on a yearly basis for a maximum of two (2) years after the initial term for a <br />period no longer than the term of the original agreement, subject to the same terms and <br />conditions set forth in this Agreement; and <br /> <br />WHEREAS, the City Manager has determined it would be in the City's best interest to <br />renew the FDOT Maintenance Agreement for the health, welfare and benefit of the citizens of <br />Sunny Isles Beach. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Approval of Joint Proiect Agreement. The City Commission hereby approves the <br />Joint Project Agreement from the Florida Department of Transportation (FDOT), attached hereto <br />as Exhibit "A," for continuing the turf and landscape maintenance of SR-AIA (Collins Avenue) <br />and SR-826 (Sunny Isles Boulevard), commencing July I, 2009 through June 30, 2010. <br /> <br />Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute said <br />Agreement. <br /> <br />Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all <br />things necessary to effectuate the terms of the Agreement. <br /> <br />Section 4. <br /> <br />Effective Date.
